Stat. tit. 59, § 59-858-709A","heading":"Criminal history records check","body":"For purposes of the Oklahoma Certified Real Estate Appraisers\n\nAct, the required criminal history records check shall include a\n\nstate and national criminal history records search conducted by the\n\nOklahoma State Bureau of Investigation that is not more than ninety\n\n(90) days old. Each criminal background check shall require:\n\n1. The applicant shall submit a full set of usable fingerprints\n\nthat is not more than ninety (90) days old to the Real Estate\n\nAppraiser Board for the purpose of permitting a state and federal\n\ncriminal history records search pursuant to Section 150.9 of Title\n\n74 of the Oklahoma Statutes. The OSBI may exchange these\n\nfingerprints with the Federal Bureau of Investigation (FBI);\n\n2. The applicant shall furnish the Board fingerprints as\n\nestablished by Board rules and any applicable fees as required by a\n\nstate or federal law enforcement agency to process the background\n\ncheck;\n\n3. The Board shall forward the fingerprints along with the\n\napplicable fee for a national criminal records history search to the\n\nOSBI. The Bureau shall retain one set of fingerprints in the\n\nAutomated Fingerprint Identification System and submit the other set\n\nto the FBI for a national criminal history records search;\n\n4. Any and all state and federal criminal history record\n\ninformation obtained by the Board from the OSBI or the FBI that is\n\nnot already a matter of public record shall be deemed confidential.\n\nThe confidential information shall be restricted to the exclusive\n\nuse of the Board, its members, officers, investigators, agents and\n\nattorneys in evaluating the applicant's eligibility or\n\ndisqualification for licensure; and\n\n5. Fingerprint images may be rejected by the OSBI or the FBI\n\nfor a variety of reasons, including, but not limited to, fingerprint\n\nquality or an inability by the OSBI or the FBI to classify the\n\nfingerprints. These rejections require the applicant to be\n\nfingerprinted again. Applicants with fingerprints rejected will be\n\nrequired to repay and be re-fingerprinted.
