An AMC shall not remove an appraiser from its appraiser\n\npanel, or otherwise refuse to assign requests for real estate\n\nappraisal services to an appraiser without:\n\n1. Notifying the appraiser in writing of the reasons why the\n\nappraiser is being removed from the appraiser panel of the AMC;\n\n2. Providing an opportunity for the appraiser to respond to the\n\nwritten notification of the AMC either personally or through legal\n\ncounsel; and\n\n3. If the appraiser is being removed from the panel for illegal\n\nconduct, violation of the USPAP, or a violation of the Oklahoma\n\nCertified Real Estate Appraisers Act or the rules promulgated\n\nthereunder, providing notice to the appraiser and to the Oklahoma\n\nReal Estate Appraiser Board detailing allegations of fact and\n\nalleged violations of standards or laws.\n\nB. An appraiser that is removed from the appraiser panel of an\n\nAMC for alleged illegal conduct, violation of the USPAP, or\n\nviolation of the Oklahoma Certified Real Estate Appraisers Act or\n\nthe rules promulgated thereunder, may file a complaint with the\n\nBoard for a review of the decision of the AMC, except that in no\n\ncase shall the Board make any determination regarding the nature of\n\nthe business relationship between the appraiser and the AMC which is\n\nunrelated to the actions specified in subsection A of this section.\n\nC. If an appraiser files a complaint against an AMC pursuant to\n\nsubsection B of this section, the Board shall adjudicate the\n\ncomplaint within one (1) year.\n\nD. If after opportunity for hearing and review, the Board\n\ndetermines that an appraiser did not commit a violation of law, a\n\nviolation of the USPAP, or a violation of the Oklahoma Certified\n\nReal Estate Appraisers Act or the rules promulgated thereunder, the\n\nBoard shall order that an appraiser be promptly reinstated to the\n\nappraiser panel of the AMC that was the subject of the complaint,\n\nwithout prejudice.\n\nE. Following the adjudication of a complaint to the Board by an\n\nappraiser against an AMC, an AMC may not refuse to make assignments\n\nfor real estate appraisal services to an appraiser, or reduce the\n\nnumber of assignments, or otherwise penalize the appraiser, if the\n\nBoard has found that the AMC acted improperly in removing the\n\nappraiser from the appraiser panel and ordered the appraiser's\n\nreinstatement.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"844fa9dc71ee87a768bc9c114ed564080807195d28829ed2824d2c27dfd3fba1","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-858-823","next":"us-ok/okla.-stat.-tit.-59-59-858-825"},"notice":"GroundRules: Original legal text.
