Stat. tit. 59, § 59-888.5","heading":"Practices, services and activities not prohibited","body":"Nothing in the Occupational Therapy Practice Act shall be\n\nconstrued to prevent or restrict the practice, services, or\n\nactivities of:\n\n1. Any persons of other licensed professions or personnel\n\nsupervised by licensed professions in this state from performing\n\nwork incidental to the practice of their profession or occupation,\n\nif that person does not represent himself as an occupational\n\ntherapist or occupational therapy assistant;\n\n2. Any person employed as an occupational therapist or\n\noccupational therapy assistant by the Government of the United\n\nStates if such person provides occupational therapy solely under the\n\ndirection or control of the organization by which he or she is\n\nemployed;\n\n3. Any person pursuing a course of study leading to a degree or\n\ncertificate in occupational therapy at an accredited educational\n\nprogram if such activities and services constitute a part of a\n\nsupervised course of study, if such a person is designated by a\n\ntitle which clearly indicates his status as a student or trainee;\n\n4. Any person fulfilling the supervised field work experience\n\nrequirements of Section 888.6 of this title, if such activities and\n\nservices constitute a part of the experience necessary to meet the\n\nrequirements of that section;\n\n5. Any person performing occupational therapy services in this\n\nstate, if services are performed for no more than ninety (90) days\n\nin a calendar year in association with an occupational therapist\n\nlicensed pursuant to the provisions of this act, if:\n\na. such person is licensed according to the laws of\n\nanother state which has licensure requirements equal\n\nto or surpassing the requirements of the Occupational\n\nTherapy Practice Act, or\n\nb. such person is certified as an occupational therapist\n\nregistered (O.T.R.) or a certified occupational\n\ntherapy assistant (C.O.T.A.), by the National Board\n\nfor Certification in Occupational Therapy;\n\n6. Any person employed or working under the direct supervision\n\nof an occupational therapist as an occupational therapy aide; or\n\n7.
