Stat. tit. 59, § 59-942","heading":"Acts by unlicensed persons prohibited - Permissible acts","body":"on prescription - Repairs.\n\nA. It shall be unlawful for any person, firm, corporation,\n\ncompany, or partnership not licensed pursuant to the provisions of\n\nChapter 11, Chapter 13 or Chapter 14 of this title, to:\n\n1. Fit, adjust, adapt, or to in any manner apply lenses,\n\nframes, prisms, or any other optical appliances to the face of a\n\nperson;\n\n2. Duplicate or attempt to duplicate, or to place or replace\n\ninto the frames, any lenses or other optical appliances which have\n\nbeen prescribed, fitted, or adjusted for visual correction, or which\n\nare intended to aid human vision;\n\n3. Give any treatment or training designed to aid human vision;\n\nor\n\n4. Represent or hold oneself out to the public as being\n\nqualified to do any of the acts listed in this section.\n\nB. 1. Persons licensed pursuant to the provisions of Chapters\n\n11, 13 or 14 of this title may in a written prescription, or its\n\nduplicate, authorize any optical supplier to interpret the\n\nprescription. The optical supplier:\n\na. may, in accordance with a written prescription or its\n\nduplicate, measure, adapt, fit, prepare, dispense, or\n\nadjust such lenses, spectacles, eyeglasses, prisms,\n\ntinted lenses, frames or appurtenances thereto, to the\n\nhuman face for the aid or correction of visual or\n\nocular anomalies of the human eye, and\n\nb. may continue to do such acts upon a written\n\nprescription, or its duplicate.\n\n2. The physician or optometrist writing such prescription shall\n\nremain responsible for the full effect of the appliances so\n\nfurnished by the other person.\n\nC. 1. It is hereby prohibited and declared contrary to the\n\npublic health and public policy of this state to dispense, supply,\n\nfit, adjust, adapt, or in any manner apply contact lenses to the\n\neyes of a person whether or not those contact lenses are designed to\n\naid or correct human vision or are plano or cosmetic contact lenses,\n\nwithout a prescription issued by a person licensed pursuant to\n\nChapter 11, Chapter 13 or Chapter 14 of this title.\n\n2. The Board of Examiners in Optometry may secure an\n\ninjunction, without bond, in the district courts to prevent the\n\ndispensing, supplying, fitting, adjusting, or adapting of any\n\ncontact lens without a prescription.\n\n3. As used in this section, “plano” means a contact lens with\n\nno prescription power.\n\nD.
