No person, firm or corporation shall publish or display, or\n\ncause or permit to be published or displayed in any newspaper or by\n\nradio, television, window display, poster, sign, billboard or any\n\nother means, any statement or advertisement concerning ophthalmic\n\nlenses, frames, eyeglasses, spectacles or parts thereof, that is\n\nfraudulent, deceitful or misleading, including statements or\n\nadvertisements of discount, premiums, price, gifts or any statements\n\nor advertisements of a similar nature, import or meaning or which is\n\nlikely to mislead or deceive because in context it makes only a\n\npartial disclosure of relevant facts.\n\nB. No person, firm or corporation shall publish or display or\n\ncause or permit to be published or displayed in any newspaper, or by\n\nradio, television, window display, poster, sign, billboard or any\n\nother means of media, any statement or advertisement of or reference\n\nto the price or prices of any eyeglasses, spectacles, lenses, frames\n\nor any other optical device or materials or parts thereof requiring\n\na prescription from a licensed physician or optometrist unless such\n\nperson, firm or corporation complies with the provisions of\n\nsubsections C through E of this section.\n\nC. Any advertisement or statement published or displayed that\n\ncontains the price of an item in any of the following categories:\n\n1. Single vision lenses;\n\n2. Kryptok bifocal lenses;\n\n3. Regular bifocal lenses;\n\n4. Trifocal lenses;\n\n5. Aphakic lenses;\n\n6. Prism lenses;\n\n7. Double segment bifocal lenses;\n\n8. Subnormal vision lenses;\n\n9. Tinted lenses; and\n\n10. Frames;\n\nor any other items advertised shall also contain the prices of all\n\nitems in the same category. All items and prices shall be published\n\nor displayed with equal prominence. No advertisement that shows the\n\nprice of items listed in the categories shown above shall contain\n\nany language which directly or indirectly compares the prices so\n\nquoted with any other prices of similar items. In showing the price\n\nof all items in any category, it shall be permissible to combine two\n\nor more categories into one general category of \"all other lenses\"\n\nand designate the price thereby of \"up to $_____,\" which represents\n\nthe highest price of any lenses included within this combined\n\ngeneral category. Should there be a category in which two or more\n\nprice differentials exist, it shall be permissible for the category\n\nto have a single listing in the advertisement with the lowest and\n\nthe highest price in the category designated.\n\nD. In the event the dispensing optician owns more than one\n\noffice, the prices for all eyeglasses, spectacles, lenses, frames or\n\nother optical devices or materials or parts thereof in the same\n\ncategory shall be the same in all offices located within the same\n\ncounty or city regardless of the name under which the dispensing\n\noptician operates the offices.\n\nE. All items advertised by price in accordance with this\n\nsection shall be available at the advertised price without limit to\n\nquantity unless the advertisement contained quantity limitations to\n\nall persons including, but not limited to, individuals, physicians,\n\noptometrists and dispensing opticians.\n\nF. Any advertisement quoting a price or prices of spectacles,\n\neyeglasses and other optical appliances only, shall contain a\n\nreadily legible statement that the quoted price or prices \"Does not\n\ninclude professional services of an examining optometrist or\n\nphysician.\"\n\nG. Dispensers of optical appliances or devices are subject to\n\nthe Oklahoma Deceptive Trade Practices Act, as provided in Sections\n\n51 through 55 of Title 78 of the Oklahoma Statutes, and in addition\n\nto the civil remedies provided therein, it shall be a misdemeanor\n\nfor any dispenser of optical appliances or devices as defined herein\nfessional services of an examining optometrist or\n\nphysician.\"\n\nG. Dispensers of optical appliances or devices are subject to\n\nthe Oklahoma Deceptive Trade Practices Act, as provided in Sections\n\n51 through 55 of Title 78 of the Oklahoma Statutes, and in addition\n\nto the civil remedies provided therein, it shall be a misdemeanor\n\nfor any dispenser of optical appliances or devices as defined herein\n\nto knowingly commit a deceptive trade practice as defined in the\n\nOklahoma Deceptive Trade Practices Act.\n\nH. A person who violates any provision of this act is guilty of\n\na misdemeanor and upon conviction is punishable by a fine of not\n\nless than Fifty Dollars ($50.00) nor more than Five Hundred Dollars\n\n($500.00) or by confinement in the county jail for not less than two\n\n(2) months nor more than six (6) months, or both. A separate\n\noffense is committed each day a violation of this act occurs or\n\ncontinues. Should the violator be an optometrist, such violation\n\nalso constitutes grounds for revocation of his license to practice\n\noptometry. Provided, however, the owner, officer or employee of any\n\nadvertising media, not otherwise having a pecuniary interest in any\n\nadvertising authorized by the provisions of this act, shall not be\n\nguilty of the misdemeanor hereinabove defined by reason of the\n\npublishing or other delivery of any advertising furnished by a\n\nvendor of the service or material so advertised.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f4c8a1107f58664682c75c935caaf9639d3fdea18a48e6e8b5f9fc20b2c33876","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-942","next":"us-ok/okla.-stat.-tit.-59-59-943.2"},"notice":"GroundRules: Original legal text.
