Stat. tit. 59, § 59-985","heading":"Bonds - Service of process","body":"At the time of filing said application, and as a part thereof,\n\nthe applicant shall file and deposit with the said county treasurer\n\na bond, with sureties to be approved by the said county treasurer,\n\nin the penal sum of two times the value of the merchandise proposed\n\nto be offered for sale at public auction as shown by the inventory\n\nfiled, running to the State of Oklahoma, and for the use and benefit\n\nof any purchaser of any such new goods, wares or merchandise at the\n\nsaid auction who might have a cause of action of any nature arising\n\nfrom or out of a sale or sales at such auction or against the\n\napplicant or against the auctioneer; the said bond shall be further\n\nconditioned on the payment by the applicant of all taxes that may be\n\npayable by or due from, the applicant to the State of Oklahoma or\n\nany department thereof or any subdivision of the State of Oklahoma,\n\nmunicipal or otherwise, the payment of any fines that may be\n\nassessed by any court against the applicant or against the\n\nauctioneer for violation of the provisions of this act, and the\n\nsatisfaction of all causes of action commenced within one (1) year\n\nfrom the date that such sale is made at any such auction and arising\n\ntherefrom provided, however, that the aggregate liability of the\n\nsurety for all said taxes, fines, and causes of action shall in no\n\nevent exceed the sum of such bond but there shall be no limitation\n\nof liability against the owners of the new goods, wares and\n\nmerchandise or the auctioneer or the applicant for the license.\n\nIn such bond the applicant and surety shall appoint the\n\ntreasurer of said county in which said bond is filed the agent of\n\nthe applicant and the surety for the service of process. At the\n\ntime that said bond is filed and deposited with the county treasurer\n\nas herein provided the auctioneer shall appoint the said county\n\ntreasurer the agent of the auctioneer for the service of process. In\n\nthe event of such service of process, the agent on whom such service\n\nis made shall, within five (5) days after the service, mail by\n\nordinary mail a true copy of the process served upon him to each\n\nparty for whom he has been served, addressed to the last known\n\naddress of such party. Failure to so mail said copy shall not,\n\nhowever, affect the court's jurisdiction.\n\nThe State of Oklahoma or any department or subdivision,\n\nmunicipal or otherwise, thereof, or any person having a cause of\n\naction arising out of any sale of such new goods, wares or\n\nmerchandise may join the applicant and the surety on such bond and\n\nthe auctioneer in the same action, or may in such action due either\n\nsuch applicant or the surety or the auctioneer alone.","path":["OK Code","Title 59"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os59.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"18a2e28bd997edd0e6afb6b15a8621b668c32e5198fed86d24c4452c37ee1e59","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-59-59-984","next":"us-ok/okla.-stat.-tit.-59-59-986"},"notice":"GroundRules: Original legal text.
