As used in this section, “lender” means a bank, savings and\n\nloan association, savings bank, credit union, finance company,\n\nmortgage bank, mortgage broker and any affiliate.\n\nB. No person shall include the name, trade name or trademark of\n\na lender or a name, trade name or trademark similar to that of a\n\nlender in a solicitation for products or services without the\n\nconsent of the lender unless the solicitation clearly and\n\nconspicuously states in bold-faced type on the front page of the\n\ncorrespondence that the person is not sponsored by or affiliated\n\nwith a lender and that the solicitation is not authorized by the\n\nlender, which shall be identified by name. The statement shall\n\ninclude the name, address and telephone number of the person making\n\nthe solicitation and that any loan information referenced was not\n\nprovided by the lender.\n\nC. No person may include a loan number, loan amount or other\n\nspecific loan information that is not publicly available in a\n\nsolicitation for the purchase of products and services.\n\nD. No person may include a loan number, loan amount or other\n\nspecific loan information that is publicly available in a\n\nsolicitation for the purchase of products and services if use of\n\nsuch information is prohibited by this title.\n\nE. No person may include a loan number, loan amount or other\n\nspecific loan information that is publicly available in a\n\nsolicitation for the purchase of products and services and allowed\n\nby this title, unless the solicitation clearly and conspicuously\n\nstates in bold-faced type on the front page of the correspondence\n\nthat the person is not sponsored by or affiliated with the lender\n\nand that the solicitation is not authorized by the lender, which\n\nshall be identified by name. The statement shall include the name,\n\naddress and telephone number of the person making the solicitation\n\nand that any loan information referenced was not provided by the\n\nlender.\n\nF. No person shall make reference to an existing lender without\n\nthe written consent of the lender or make reference to a loan\n\nnumber, loan amount or other specific loan information on the\n\noutside of an envelope, visible through the envelope window, or on a\n\npostcard in connection with any written communication that includes\n\nor contains a solicitation for products or services offered by the\n\nother lender.\n\nG. A lender or owner of a name, trade name or trademark may\n\nseek an injunction against a person who violates this section to\n\nstop the unlawful use of the name, trade name, trademark or loan\n\ninformation. The person seeking the injunction shall not have to\n\nprove actual damages as a result of the violation. Irreparable harm\n\nand interim harm to the lender or owner shall be presumed. The\n\nlender or owner seeking the injunction may seek to recover actual\n\ndamages and any profits the defendant has accrued as a result of the\n\nviolation. The prevailing party in any action brought pursuant to\n\nthis section is entitled to recover costs associated with the action\n\nand reasonable attorney fees from the other party.\n\nH. The following are exempt from the provisions of this\n\nsection:\n\n1. Any communications by a lender or its affiliates with a\n\ncurrent customer of the lender or with a person who was a customer\n\nof the lender during the immediately preceding eighteen (18) months;\n\nand\n\n2.
