No company shall act as a fiduciary in this state except:\n\n1. A state trust company;\n\n2. A state bank;\n\n3. A savings association organized under the laws of this state\n\nand authorized to act as a fiduciary pursuant to state law;\n\n4. A national bank having its principal office in this state\n\nand authorized by the Comptroller of the Currency to act as a\n\nfiduciary pursuant to 12 U.S.C., Section 92a;\n\n5. A federally chartered savings association having its\n\nprincipal office in this state and authorized by its federal\n\nchartering authority to act as a fiduciary;\n\n6. An out-of-state bank with a branch in this state established\n\nor maintained pursuant to the laws of this state or a trust office\n\nlicensed by the Commissioner pursuant to this act;\n\n7. An out-of-state trust company with a trust office licensed\n\nby the Commissioner pursuant to this act; or\n\n8. A foreign bank with a trust office licensed by the\n\nCommissioner pursuant to this act.\n\nB.
