Stat. tit. 6, § 6-1724","heading":"Enforcement actions","body":"Consistent with the Administrative Procedures Act, after notice\n\nand opportunity for a hearing:\n\n1. The Commissioner may determine:\n\na. that an office maintained by an out-of-state trust\n\ninstitution in this state is being operated in\n\nviolation of any provision of the laws of this state\n\nor in an unsafe and unsound manner, or\n\nb. that a company is engaged in an unauthorized trust\n\nactivity.\n\nIn either event, the Commissioner shall have the authority to take\n\nall such enforcement actions as the Commissioner would be empowered\n\nto take if the office or the company were a state trust company\n\nincluding, but not limited to, issuing an order temporarily or\n\npermanently prohibiting the company from engaging in a trust\n\nbusiness in this state;\n\n2. The Commissioner may determine by order that an out-of-state\n\ntrust institution engaging in or proposing to engage in a trust\n\nbusiness in this state does not meet the requirements for\n\nestablishing a representative trust office in this state pursuant to\n\nSection 22 of this act, which order shall be effective on the date\n\nof issuance or such other date as the Commissioner shall determine;\n\nand\n\n3. In cases involving extraordinary circumstances requiring\n\nimmediate action, the Commissioner may take any action permitted by\n\nparagraph 1 or 2 of this section without notice or opportunity for\n\nhearing, but shall promptly afford a subsequent hearing upon an\n\napplication to rescind the action taken.
