Stat. tit. 6, § 6-2008","heading":"Examinations - Reports - Access to information -","body":"Alternative examination or report - Failure to make and transmit or\n\npublish report - Certificate and bylaw forms - Annual financial\n\nreport.\n\nA. A regular examination of credit unions organized under the\n\nlaws of this state shall be made by or under the supervision of the\n\nAdministrator appointed by the State Banking Commissioner. The\n\nAdministrator shall investigate and examine credit unions organized\n\nunder Section 2001 et seq. of this title at least every eighteen\n\n(18) months, or more often if the Administrator and the State\n\nBanking Commissioner deem it necessary. For the purpose of making\n\nsuch examinations, examiners shall have full access to all books,\n\npapers, securities, records and other sources of information under\n\nthe control of credit unions.\n\nB. In lieu of making an examination of a credit union, an\n\nexamination or audit report of the condition of the credit union\n\nmade by the National Credit Union Administration may be accepted by\n\nthe Administrator.\n\nC. Upon receipt by the credit union or any officer thereof, the\n\nreport of examination shall be submitted by the officer receiving it\n\nto the board of directors and the supervisory committee for review\n\nat the next meeting of the board and duly noted in the minutes of\n\nthe board in such form and in such manner as may be prescribed and\n\ndirected by the Commissioner.\n\nD. Credit unions shall report to the Administrator at least\n\nsemiannually or upon request by the Administrator on forms supplied\n\nfor that purpose. Every credit union which fails to make and\n\ntransmit or to publish any report required within the discretion of\n\nthe Administrator shall be liable for an administrative violation\n\nand subject to a fine not to exceed Five Dollars ($5.00) for each\n\nday, after the period respectively therein mentioned, that the\n\ncredit union delays to make and transmit its report or its proof of\n\npublication. Whenever any credit union delays or refuses to pay the\n\nfine herein imposed for a failure to make and transmit or to publish\n\na report, the Commissioner is hereby authorized to maintain an\n\naction in the name of the state against the delinquent credit union\n\nfor the recovery of such fine, and all sums collected by such action\n\nshall be paid into the State Treasury to be credited to the General\n\nRevenue Fund.\n\nE. In order to simplify the organization of credit unions, the\n\nAdministrator shall cause to be prepared a form of organization\n\ncertificate which shall be used by credit unions organized hereunder\n\nand a form of bylaws consistent with Section 2001 et seq. of this\n\ntitle, which may be used by credit union incorporators and shall be\n\nsupplied upon request.\n\nF. The Administrator shall prepare a report each year showing\n\nthe financial condition of all credit unions under the supervision\n\nof the Administrator as of December 31 of the preceding year.
