There shall be a Banking Department, with a main office\n\nlocated at 2900 North Lincoln Boulevard, Oklahoma City, Oklahoma,\n\nwhich shall be a separate department of the state government charged\n\nwith supervision of the activities in this state as provided in the\n\nOklahoma Banking Code of 1997 and in other legislation conferring\n\njurisdiction upon the Department.\n\nB. The head of the Department shall be the Commissioner. The\n\nCommissioner shall be appointed by the Governor with the advice and\n\nconsent of the Senate. The Commissioner shall have been a qualified\n\nelector of the state for at least three (3) years prior to the\n\nappointment, shall be at least thirty-five (35) years old and shall\n\nhave had ten (10) years' experience as a bank officer or employee,\n\nor five (5) years' experience as a bank president or managing\n\nofficer of a bank, or five (5) years' experience as a state or\n\nfederal bank examiner. The Commissioner shall be appointed for a\n\nterm of four (4) years. The Commissioner shall continue to serve\n\nuntil a successor is duly appointed, confirmed and qualified. The\n\nCommissioner may be removed by the Governor for cause after notice\n\nand hearing. A successor to a Commissioner who dies, resigns or is\n\nremoved shall be appointed in the same manner as provided in this\n\nsection.\n\nC. 1. The Commissioner shall appoint a Deputy Commissioner who\n\nmay also serve as secretary to the Board hereinafter created. The\n\nDeputy Commissioner shall have been a qualified elector of the state\n\nfor at least three (3) years prior to the appointment, shall be at\n\nleast thirty (30) years old and shall have had five (5) years'\n\nexperience as a bank officer or employee, or three (3) years'\n\nexperience as a bank president or managing officer of a bank, or\n\nfive (5) years' experience as a state or federal bank examiner,\n\nAssistant Deputy Commissioner, or other Department employee. If the\n\noffice of the Commissioner is vacant or if the Commissioner is\n\nabsent or unable to act, the Deputy Commissioner shall be the acting\n\nCommissioner.\n\n2. The Commissioner may appoint Administrative Assistants whose\n\nadministrative duties shall be prescribed by the Commissioner.\n\n3. The Attorney General is hereby authorized to appoint an\n\nAssistant Attorney General, in addition to those now provided by\n\nlaw, to be assigned to the Department. The Assistant Attorney\n\nGeneral shall perform such additional duties as may be assigned by\n\nthe Attorney General, and shall otherwise be subject to all\n\nprovisions of the statutes relating to Assistant Attorneys General.\n\nThe Banking Department is authorized to pay all or any part of the\n\nsalary of the Assistant Attorney General.\n\n4. The Commissioner may also appoint a Budget Director for the\n\nDepartment, a Credit Union Administrator and Assistant Deputy\n\nCommissioners. The Budget Director, Credit Union Administrator and\n\nAssistant Deputy Commissioners shall have the duties and authority\n\nas prescribed by the Commissioner.\n\n5. The Commissioner shall prepare in writing a manual of all\n\nemployee positions for the Department, including job\n\nclassifications, seniority status, personnel qualifications, duties,\n\nmaximum and minimum salary schedules and other personnel information\n\nfor approval by the Board. The Commissioner may select, appoint and\n\nemploy such accountants, attorneys, auditors, examiners, clerks,\n\nsecretaries, stenographers and other personnel as the Commissioner\n\ndeems necessary for the proper administration of the Department and\n\nany other statutory duties of the Commissioner.\n\nD. All officers and employees of the Department shall be in the\n\nexempt unclassified service as provided for in Section 840-5.5 of\n\nTitle 74 of the Oklahoma Statutes. All future appointees to such\n\npositions shall be in the exempt unclassified service. Except as\n\nprovided in subsection B of this section, officers and employees of\nthe Department and\n\nany other statutory duties of the Commissioner.\n\nD. All officers and employees of the Department shall be in the\n\nexempt unclassified service as provided for in Section 840-5.5 of\n\nTitle 74 of the Oklahoma Statutes. All future appointees to such\n\npositions shall be in the exempt unclassified service. Except as\n\nprovided in subsection B of this section, officers and employees of\n\nthe Department shall not be terminable except for cause as defined\n\nby the Board.\n\nE. The Commissioner may delegate to any officer or employee of\n\nthe Department any of the powers of the Commissioner and may\n\ndesignate any officer or employee of the Department to perform any\n\nof the duties of the Commissioner.\n\nF. The Commissioner, Deputy Commissioner, Assistants to the\n\nCommissioner, credit union administrator, budget director, Assistant\n\nDeputy Commissioners, examiners, examiner-trainees, and all other\n\npersonnel shall, before entering upon the discharge of their duties,\n\ntake and subscribe to the oath of office required of state officers\n\nas provided by Section 36.2A of Title 51 of the Oklahoma Statutes.\n\nG. 1. The Commissioner shall adopt an appropriate seal as the\n\nSeal of the State Banking Commissioner.\n\n2. Every certificate, assignment and conveyance executed by the\n\nCommissioner, in pursuance of the authority conferred upon the\n\nCommissioner by law and sealed with the seal of the Department,\n\nshall be received in evidence and recorded in the proper recording\n\noffices in the same manner as a deed regularly acknowledged, as\n\nrequired by law.\n\n3. Whenever it is necessary for the Commissioner to approve any\n\ninstrument or to affix the official seal thereto, the Commissioner\n\nmay charge a fee for affixing the approval of the Commissioner or\n\nthe official seal to such instrument. Copies of all records and\n\npapers in the office of the Department, certified by the\n\nCommissioner and authenticated by the seal, shall be received in\n\nevidence in all cases equally and of like effect as the original.\n\nWhenever it is proper to furnish a copy of any paper filed in the\n\nDepartment or to certify such paper, the Commissioner may charge a\n\nfee for furnishing such copy, for affixing the official seal on such\n\ncopy and/or for certifying the same.","path":["OK Code","Title 6"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os6.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"878dca24562f65ec35a50dcdb6fd7d20c6d60cb6ce520c5bd1bfb9d2a05dfa96","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-6-6-2009","next":"us-ok/okla.-stat.-tit.-6-6-201.1"},"notice":"GroundRules: Original legal text.
