The following records in the Oklahoma State Banking\n\nDepartment are designated as public records:\n\n1. All applications for state bank charters and supporting\n\ninformation with the exception of personal financial records of\n\nindividual applicants;\n\n2. All records introduced at public hearings on bank charter\n\napplications;\n\n3. Information disclosing the failure of a state bank, an out-\n\nof-state bank and branches of out-of-state banks located in this\n\nstate and the reasons therefor;\n\n4. Reports of completed investigations which uncover a shortage\n\nof funds in a bank, an out-of-state bank and branches of out-of-\n\nstate banks located in this state, after the reporting of the\n\nshortage to proper authorities by the State Banking Commissioner.\n\nHowever, nothing in this paragraph shall be construed to mean that\n\nreports prepared by the Department in connection with routine,\n\nspecial, or conversion examinations of banks, trust companies, or\n\nother entities subject to examination by the Department are public\n\nrecord;\n\n5. Names of all stockholders and officers of banks, out-of-\n\nstate banks, out-of-state bank holding companies, and branches of\n\nout-of-state banks located in this state filed in the office of the\n\nSecretary of State; and\n\n6. Regular financial call reports issued at the time of the\n\nstate bank calls.\n\nB. All other records in the Department shall be confidential\n\nand not subject to public inspection. However, the Banking Board,\n\nCommissioner, or Deputy Commissioner may divulge such confidential\n\ninformation with the written approval of the Commissioner after\n\nreceipt of a written request which shall:\n\n1. Specify the record or records to which access is requested;\n\nand\n\n2. Give the reasons for the request. Such records may also be\n\nproduced pursuant to a valid judicial subpoena or other legal\n\nprocess requiring production, if the Commissioner determines that\n\nthe records are relevant to the hearing or proceeding and that\n\nproduction is in the best interests of justice. The records may be\n\ndisclosed only after a determination by the Commissioner that good\n\ncause exists for the disclosure. Either prior to or at the time of\n\nany disclosure, the Commissioner shall impose such terms and\n\nconditions as the Commissioner deems necessary to protect the\n\nconfidential nature of the record, the financial integrity of any\n\ninstitution to which the record relates, and the legitimate privacy\n\ninterests of any individual named in such records. If any request\n\nis made for a copy of an examination report relating to a state\n\nbank, trust company, savings association, or credit union, the\n\nrequest must be accompanied by documentation which indicates no\n\nobjection by the primary federal regulator having jurisdiction over\n\nthe bank, trust company, savings association, or credit union to\n\nwhich the examination report relates.\n\nC. All documents which the Department is required, by any\n\nprovision of the Oklahoma Banking Code or by any other statute or\n\nregulation of this state, to retain or preserve in its possession\n\nmay be retained and preserved, in lieu of retention of the original\n\nrecords or copies, in an electronic format and stored by electronic\n\nimaging or otherwise so that the documents may be later reproduced\n\nas necessary. Any such electronically stored or imaged document or\n\nreproduction shall have the same force and effect as the original\n\nthereof and be admitted in evidence equally with the original.\n\nD. With respect to records of the Department which are\n\nconsidered public records, and which are subject to the Oklahoma\n\nOpen Records Act, the Department may charge a document copying fee\n\nof twenty-five cents ($0.25) per page. With respect to records of\n\nthe Department which are not considered public records, the\n\nDepartment may charge a document copying fee of One Dollar ($1.00)\n\nper page, and when the Commissioner, pursuant to the provisions of\nre\n\nconsidered public records, and which are subject to the Oklahoma\n\nOpen Records Act, the Department may charge a document copying fee\n\nof twenty-five cents ($0.25) per page. With respect to records of\n\nthe Department which are not considered public records, the\n\nDepartment may charge a document copying fee of One Dollar ($1.00)\n\nper page, and when the Commissioner, pursuant to the provisions of\n\nparagraph 2 of subsection B of this section, permits the inspection\n\nor copying of an examination report prepared by the Department, a\n\nminimum fee of One Hundred Dollars ($100.00) shall be charged.","path":["OK Code","Title 6"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os6.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"891d15665cb6062d7fa407238bf634136e1d53394f40c7615effee6e061db9df","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-6-6-207","next":"us-ok/okla.-stat.-tit.-6-6-208.1"},"notice":"GroundRules: Original legal text.
