Preservation of records. Every bank and trust company shall\n\nretain its business records for such periods as are or may be\n\nprescribed by or in accordance with the terms of this section.\n\nB. Permanent records. Each bank and trust company shall retain\n\npermanently the minute books of meetings of its stockholders and\n\ndirectors, its capital stock ledger and capital stock certificate\n\nledger or stubs, its general ledger (or the record kept by the bank\n\nin lieu thereof), its daily statements of condition, and all records\n\nwhich the Board shall, in accordance with the terms of this section,\n\nrequire to be retained permanently.\n\nC. Disposal of other records. All other bank and trust company\n\nrecords shall be retained for such periods as the Board shall, in\n\naccordance with the terms of this section, prescribe.\n\nD. Records - Regulations of Board. The Board shall from time\n\nto time issue regulations classifying all records kept by banks and\n\ntrust companies and prescribing the period for which records of each\n\nclass shall be retained. Such periods may be permanent or for a\n\nterm of years. Such regulations may be amended or repealed. Prior\n\nto issuing any such regulation the Board shall consider:\n\n1. Actions and administrative proceedings in which the\n\nproduction of bank or trust company records might be necessary or\n\ndesirable;\n\n2. State and federal statutes of limitation applicable to such\n\nactions or proceedings;\n\n3. The availability of information contained in bank and trust\n\ncompany records from other sources; and\n\n4. Such other matters as the Board shall deem pertinent in\n\norder that its regulations will require banks and trust companies to\n\nretain their records for such periods as are commensurate with the\n\ninterests of their customers and shareholders and of the people of\n\nthis state in having such records available.\n\nE. Disposal - No duty to thereafter produce. Any bank or trust\n\ncompany may dispose of any record which has been retained for the\n\nperiod prescribed, in accordance with the terms of this section for\n\nretention of records of its class, and shall, after it has disposed\n\nof a record, thereafter be under no duty to produce such record in\n\nany action or proceeding.\n\nF. Permission to reproduce records - Admissibility. In lieu of\n\nretention of the original records, any bank or trust company may\n\ncause any, or all, of its records, and records at any time in its\n\ncustody, including those held by it as a fiduciary, to be\n\nphotographed, stored by electronic imaging or otherwise reproduced\n\nin permanent form. Any such photograph, imaged document or\n\nreproduction shall have the same force and effect as the original\n\nthereof and be admitted in evidence equally with the original.\n\nG. Section applicable to all banks and trust companies.
