Stat. tit. 6, § 6-412","heading":"Signature guaranty","body":"(1) A bank may become guarantor of the genuineness of a\n\nsignature.\n\n(2) A bank guaranteeing the signature of a person on any\n\ndocument warrants to any person relying on such guaranty only that:\n\n(a) the signature is that of the person signing; and\n\n(b) the signer is the holder, or the signer has purported\n\nauthority to sign in the name of the holder; provided that if the\n\nholder purports to act as a fiduciary either as \"fiduciary\" as\n\ndefined in this Code or his name is signed by a person purporting to\n\nact on the holder's behalf as a fiduciary, the bank warrants that\n\nsuch holder or such person so signing as such fiduciary is in fact\n\nthe fiduciary he purports to be and warrants that the bank has no\n\nactual knowledge that such fiduciary is committing a breach of his\n\nobligation as such fiduciary in signing such document and that it\n\nhas no knowledge of such facts that its action in guaranteeing the\n\nsignature amounts to bad faith; and\n\n(c) the signer has legal capacity to sign.\n\n(3) A bank may disclaim in its guaranty all or any part of the\n\nobligations set forth in subsection (2)(b) of this section.","path":["OK Code","Title 6"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os6.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"293a90a3c00a38125db04725b1a2762f99c8b8f4ce892e2e71adec43bcd6b043","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-6-6-411","next":"us-ok/okla.-stat.-tit.-6-6-414"},"notice":"GroundRules: Original legal text.
