Any bank, savings and loan association or credit union\n\nlocated within the State of Oklahoma may install, operate or utilize\n\nconsumer banking electronic facilities, provided written notice is\n\ngiven to the Commissioner prior to the commencement of operations of\n\neach facility. Such notice shall contain any reasonable descriptive\n\ninformation pertaining to the facility as shall be required by the\n\nrules or regulations of the Board.\n\nB. A consumer banking electronic facility, when located other\n\nthan at a bank's principal office or detached facility, may be\n\noperated exclusively by customers or transactions may be performed\n\nthrough the assistance of any person provided that person is not\n\nemployed, either directly or indirectly, by any bank, bank holding\n\ncompany or subsidiary, savings and loan association or credit union.\n\nSuch assistance shall not be deemed to be engaging in the business\n\nof banking. Persons assisting bank customers at the site of a\n\nconsumer banking electronic facility may be trained by bank\n\nemployees and nothing in this section shall be construed to prohibit\n\nperiodic servicing of a consumer banking electronic facility by a\n\nbank, savings and loan association or credit union employee. Under\n\nno circumstances may an employee of a bank, bank holding company,\n\naffiliate or subsidiary thereof, savings and loan association or\n\ncredit union perform transactions for others at the consumer banking\n\nelectronic facility. However, a consumer banking electronic\n\nfacility located on the business premises of a person engaged in the\n\nsale of goods or services may be used to perform internal nonbanking\n\nfunctions for such persons.\n\nC. Consumer banking electronic facility transactions shall be\n\nconsidered as the conduct of banking transactions at the\n\nheadquarters' location of the bank, savings and loan association or\n\ncredit union for which the data is transmitted.\n\nD. A person not holding a certificate of authority to operate\n\nas a bank, credit union, or savings association may install, operate\n\nand utilize consumer banking electronic facilities only after filing\n\na registration statement with the Banking Department pursuant to the\n\nrequirements of Section 104 of this title and any rules promulgated\n\nthereunder by the State Banking Board. Provided however, a person\n\nfiling a registration statement solely in connection with bank or\n\ntrust-related activities involving consumer banking electronic\n\nfacilities shall pay to the Department a fee no greater than Fifty\n\nDollars ($50.00) per facility, up to a maximum of Five Hundred\n\nDollars ($500.00), notwithstanding any rule by the Board that may\n\nestablish a higher fee.","path":["OK Code","Title 6"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os6.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d044aae6a07034fd96ccfbf5d5febb2910eee6a423db5e669ba092ec9f2ac0d9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-6-6-421","next":"us-ok/okla.-stat.-tit.-6-6-423"},"notice":"GroundRules: Original legal text.
