Stat. tit. 60, § 60-1202","heading":"Definitions","body":"As used in the Oklahoma Uniform Directed Trust Act of 2024:\n\n1. \"Breach of trust\" means a violation by a trust director or\n\ntrustee of a duty imposed on that director or trustee by the terms\n\nof the trust, this act, or laws of this state other than this act\n\npertaining to trusts;\n\n2. \"Directed trust\" means a trust for which the terms of the\n\ntrust grant a power of direction;\n\n3. \"Directed trustee\" means a trustee that is subject to a\n\ntrust director's power of direction;\n\n4. \"Person\" means an individual, estate, business or nonprofit\n\nentity, public corporation, government or governmental subdivision,\n\nagency, or instrumentality, or other legal entity;\n\n5. \"Power of direction\" means a power over a trust granted to a\n\nperson by the terms of the trust to the extent the power is\n\nexercisable while the person is not serving as a trustee. The term\n\nincludes a power over the investment, management, or distribution of\n\ntrust property or other matters of trust administration. The term\n\nexcludes the powers described in subsection B of Section 6 of this\n\nact;\n\n6. \"Settlor\" means a person, including a testator, that creates\n\nor contributes property to a trust. If more than one person creates\n\nor contributes property to a trust, each person is a settlor of the\n\nportion of the trust property attributable to that person's\n\ncontribution except to the extent another person has the power to\n\nrevoke or withdraw that portion;\n\n7. \"State\" means a state of the United States, the District of\n\nColumbia, Puerto Rico, the United States Virgin Islands, or any\n\nother territory or possession subject to the jurisdiction of the\n\nUnited States;\n\n8. \"Terms of a trust\" means:\n\na. except as otherwise provided in subparagraph b of this\n\nparagraph, the manifestation of the settlor's intent\n\nregarding a trust's provisions as:\n\n(1) expressed in the trust instrument, or\n\n(2) established by other evidence that would be\n\nadmissible in a judicial proceeding, or\n\nb. the trust's provisions as established, determined, or\n\namended by:\n\n(1) a trustee or trust director in accordance with\n\napplicable law, or\n\n(2) a court order;\n\n9. \"Trust director\" means a person that is granted a power of\n\ndirection by the terms of a trust to the extent the power is\n\nexercisable while the person is not serving as a trustee.
