Subject to subsection B of this section, with respect to a\n\npower of direction or further power under paragraph 1 of subsection\n\nB of Section 7 of this act:\n\n1. A trust director has the same fiduciary duty and liability\n\nin the exercise or nonexercise of the power:\n\na. if the power is held individually, as a sole trustee\n\nin a like position and under similar circumstances, or\n\nb. if the power is held jointly with a trustee or another\n\ntrust director, as a cotrustee in a like position and\n\nunder similar circumstances; and\n\n2. The terms of the trust may vary the director's duty or\n\nliability to the same extent the terms of the trust could vary the\n\nduty or liability of a trustee in a like position and under similar\n\ncircumstances.\n\nB. Unless the terms of a trust provide otherwise, if a trust\n\ndirector is licensed, certified, or otherwise authorized or\n\npermitted by law other than this act to provide health care in the\n\nordinary course of the director's business or practice of a\n\nprofession, to the extent the director acts in that capacity, the\n\ndirector has no duty or liability under this act.\n\nC.
