Stat. tit. 60, § 60-1312","heading":"Cause of action or claim for relief by creditor of","body":"transferor — Requirements.\n\nA. A cause of action or claim for relief with respect to a\n\nqualified disposition of a transferor's assets under Section 29 of\n\nthis act is extinguished unless the action under Section 29 of this\n\nact may only be brought by a creditor of the transferor who meets\n\none of the following requirements:\n\n1. Is a creditor of the settlor before the settlor's assets are\n\ntransferred to the trust; or\n\n2. Becomes a creditor subsequent to the transfer into trust,\n\nand the asset was listed on a financial statement provided to a bank\n\nor financial institution by or on behalf of the transferor for the\n\npurpose of obtaining credit as a borrower, guarantor, surety,\n\npledgor, or otherwise.\n\nB. Any action under Section 29 of this act may be filed at any\n\ntime, but in any event not later than five (5) years after the\n\ncreditor has obtained a final, unappealable judgment against the\n\ntransferor. In such action, the creditor may proceed against the\n\ntransferred property or recover the value thereof in an amount up to\n\nthe amount of such judgment against the transferor.\n\nC.
