The following provisions apply only to discretionary\n\ninterests:\n\n1. A discretionary interest is neither a property interest nor\n\nan enforceable right. It is a mere expectancy;\n\n2. No creditor may force a distribution with regard to a\n\ndiscretionary interest. No creditor may require the trustee to\n\nexercise the trustee's discretion to make a distribution with regard\n\nto a discretionary interest; and\n\n3. A court may review a trustee's distribution discretion only\n\nif the trustee:\n\na. acts dishonestly,\n\nb. acts with an improper motive, or\n\nc. fails, if under a duty to do so, to act.\n\nB. A reasonableness standard may not be applied to the exercise\n\nof discretion by the trustee with regard to a discretionary\n\ninterest. Other than for the circumstances listed in this section,\n\na court has no jurisdiction to review the trustee's discretion or to\n\nforce a distribution.\n\nC. Absent express language to the contrary, in the event that\n\nthe distribution language in a discretionary interest permits\n\nunequal distributions between beneficiaries or distributions to the\n\nexclusion of other beneficiaries, the trustee may distribute all of\n\nthe accumulated, accrued, or undistributed income and principal to\n\none beneficiary in the trustee's discretion.\n\nD. Regardless of whether a beneficiary has any outstanding\n\ncreditors, a trustee of a discretionary interest may directly pay\n\nany expense on behalf of such beneficiary and may exhaust the income\n\nand principal of the trust for the benefit of such beneficiary.
