Stat. tit. 60, § 60-1502","heading":"Definitions","body":"As used in this act:\n\n1. \"Appurtenant easement\" means an easement tied to or\n\ndependent on ownership or occupancy of a unit or a parcel of real\n\nproperty;\n\n2. \"Conservation easement\" means a nonpossessory property\n\ninterest created for one or more of the following conservation\n\npurposes:\n\na. retaining or protecting the natural, scenic, wildlife,\n\nwildlife-habitat, biological, ecological, or open-\n\nspace values of real property,\n\nb. ensuring the availability of real property for\n\nagricultural, forest, outdoor-recreational, or open-\n\nspace uses,\n\nc. protecting natural resources, including wetlands,\n\ngrasslands, and riparian areas,\n\nd. maintaining or enhancing air or water quality, or\n\ne. preserving the historical, architectural,\n\narcheological, paleontological, or cultural aspects of\n\nreal property;\n\n3. \"Dominant estate\" means an estate or interest in real\n\nproperty benefitted by an appurtenant easement;\n\n4. \"Easement\" means a nonpossessory property interest that:\n\na. provides a right to enter, use, or enjoy real property\n\nowned by or in the possession of another, and\n\nb. imposes on the owner or possessor a duty not to\n\ninterfere with the entry, use, or enjoyment permitted\n\nby the instrument creating the easement or, in the\n\ncase of an easement not established by express grant\n\nor reservation, the entry, use, or enjoyment\n\nauthorized by law;\n\n5. \"Easement holder\" means:\n\na. in the case of an appurtenant easement, the dominant\n\nestate owner, or\n\nb. in the case of an easement in gross, public-utility\n\neasement, conservation easement, or negative easement,\n\nthe grantee of the easement or a successor;\n\n6. \"Easement in gross\" means an easement not tied to or\n\ndependent on ownership or occupancy of a unit or a parcel of real\n\nproperty;\n\n7. \"Lessee of record\" means a person holding a lessee's\n\ninterest under a recorded lease or memorandum of lease;\n\n8. \"Negative easement\" means a nonpossessory property interest\n\nwhose primary purpose is to impose on a servient estate owner a duty\n\nnot to engage in a specified use of the estate;\n\n9. \"Person\" means an individual, estate, business or nonprofit\n\nentity, public corporation, government or governmental subdivision,\n\nagency, or instrumentality, or other legal entity;\n\n10. \"Public-utility easement\" means a nonpossessory property\n\ninterest in which the easement holder is a publicly regulated or\n\npublicly owned utility under federal law or law of this state or a\n\nmunicipality. The term includes an easement benefiting an\n\nintrastate utility, an interstate utility, or a utility cooperative;\n\n11. \"Real property\" means an estate or interest in, over, or\n\nunder land, including structures, fixtures, and other things that by\n\ncustom, usage, or law pass with a conveyance of land whether or not\n\ndescribed or mentioned in the contract of sale or instrument of\n\nconveyance. The term includes the interest of a lessor and lessee\n\nand, unless the interest is personal property under law of this\n\nstate other than this act, an interest in a common-interest\n\ncommunity;\n\n12. \"Record\", used as a noun, means information that is\n\ninscribed on a tangible medium or that is stored in an electronic or\n\nother medium and is retrievable in perceivable form;\n\n13. \"Security instrument\" means a mortgage, deed of trust,\n\nsecurity deed, contract for deed, lease, or other record that\n\ncreates or provides for an interest in real property to secure\n\npayment or performance of an obligation, whether by acquisition or\n\nretention of a lien, a lessor's interest under a lease, or title to\n\nthe real property. The term includes:\n\na. a security instrument that also creates or provides\n\nfor a security interest in personal property,\n\nb. a modification or amendment of a security instrument,\n\nand\n\nc. a record creating a lien on real property to secure an\n\nobligation under a covenant running with the real\ninterest under a lease, or title to\n\nthe real property. The term includes:\n\na. a security instrument that also creates or provides\n\nfor a security interest in personal property,\n\nb. a modification or amendment of a security instrument,\n\nand\n\nc. a record creating a lien on real property to secure an\n\nobligation under a covenant running with the real\n\nproperty or owed by a unit owner to a common-interest\n\ncommunity association;\n\n14. \"Security-interest holder of record\" means a person holding\n\nan interest in real property created by a recorded security\n\ninstrument;\n\n15. \"Servient estate\" means an estate or interest in real\n\nproperty that is burdened by an easement;\n\n16. \"Title evidence\" means a title insurance policy,\n\npreliminary title report or binder, title insurance commitment,\n\nabstract of title, attorney's opinion of title based on examination\n\nof public records or an abstract of title, or any other means of\n\nreporting the state of title to real property which is customary in\n\nthe locality;\n\n17. \"Unit\" means a physical portion of a common-interest\n\ncommunity designated for separate ownership or occupancy with\n\nboundaries described in a declaration establishing the common-\n\ninterest community; and\n\n18. \"Utility cooperative\" means a non-profit entity whose\n\npurpose is to deliver a utility service, such as electricity, oil,\n\nnatural gas, water, sanitary sewer, storm water, or\n\ntelecommunications, to its customers or members and includes an\n\nelectric cooperative, rural electric cooperative, rural water\n\ndistrict, and rural water association.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8c05f994746313b9027ba4fd49421372877e444adafe1b26ad0b364487f62cb7","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-1501","next":"us-ok/okla.-stat.-tit.-60-60-1503"},"notice":"GroundRules: Original legal text.
