To obtain an order to relocate an easement under this act, a\n\nservient estate owner must commence a civil action.\n\nB. A servient estate owner that commences a civil action under\n\nsubsection A of this section:\n\n1. Shall serve a summons and petition on:\n\na. the easement holder whose easement is the subject of\n\nthe relocation,\n\nb. a security-interest holder of record of an interest in\n\nthe servient estate or dominant estate,\n\nc. a lessee of record of an interest in the dominant\n\nestate, and\n\nd. except as otherwise provided in paragraph 2 of this\n\nsubsection, any other owner of a recorded real-\n\nproperty interest if the relocation would encroach on\n\nan area of the servient estate or dominant estate\n\nburdened by the interest; and\n\n2. Is not required to serve a summons and petition on the owner\n\nof a recorded real-property interest in oil, gas, or minerals unless\n\nthe interest includes an easement to facilitate oil, gas, or mineral\n\ndevelopment.\n\nC. A petition under this section must state:\n\n1. The intent of the servient estate owner to seek the\n\nrelocation;\n\n2. The nature, extent, and anticipated dates of commencement\n\nand completion of the proposed relocation;\n\n3. The current and proposed locations of the easement;\n\n4. The reason the easement is eligible for relocation under\n\nSection 3 of this act;\n\n5. The reason the proposed relocation satisfies the conditions\n\nfor relocation under Section 4 of this act; and\n\n6. That the servient estate owner has made a reasonable attempt\n\nto notify the holders of any public-utility easement, conservation\n\neasement, or negative easement on the servient estate or dominant\n\nestate of the proposed relocation.\n\nD. At any time before the court renders a final order in an\n\naction under subsection A of this section, a person served under\n\nsubparagraph b, c, or d of subsection B of this section may file a\n\ndocument, in recordable form, that waives its rights to contest or\n\nobtain relief in connection with the relocation or subordinates its\n\ninterests to the relocation.
