A trust is created only if:\n\n1. The settlor has capacity to create a trust;\n\n2. The settlor indicates an intention to create the trust;\n\n3. The trust has a definite beneficiary or is:\n\na. a charitable trust, or\n\nb. a trust for a noncharitable purpose, as provided in\n\nSection 27 of this act;\n\n4. The trustee has duties to perform; and\n\n5. The same person is not the sole trustee and sole\n\nbeneficiary.\n\nB. A beneficiary is definite if the beneficiary can be\n\nascertained now or in the future.\n\nC. A power in a trustee to select a beneficiary from an\n\nindefinite class is valid.
