A vacancy in a trusteeship occurs if:\n\n1. A person designated as trustee rejects the trusteeship;\n\n2. A person designated as trustee cannot be identified or does\n\nnot exist;\n\n3. A trustee resigns;\n\n4. A trustee is disqualified or removed;\n\n5. A trustee dies; or\n\n6. A guardian is appointed for an individual serving as\n\ntrustee.\n\nB. If one or more co-trustees remain in office, a vacancy in a\n\ntrusteeship need not be filled. A vacancy in a trusteeship must be\n\nfilled if the trust has no remaining trustee.\n\nC. A vacancy in a trusteeship of a noncharitable trust that is\n\nrequired to be filled must be filled in the following order of\n\npriority:\n\n1. By a person designated in the terms of the trust to act as\n\nsuccessor trustee;\n\n2. By a person appointed by unanimous agreement of the\n\nqualified beneficiaries; or\n\n3. By a person appointed by the court.\n\nD. A vacancy in a trusteeship of a charitable trust that is\n\nrequired to be filled must be filled in the following order of\n\npriority:\n\n1. By a person designated in the terms of the trust to act as\n\nsuccessor trustee;\n\n2. By a person selected by the charitable organizations\n\nexpressly designated to receive distributions under the terms of the\n\ntrust if the Office of the Attorney General concurs in the\n\nselection; or\n\n3. By a person appointed by the court.\n\nE.
