Instead of furnishing a copy of the trust instrument to a\n\nperson other than a beneficiary, and in lieu of or in addition to a\n\nmemorandum of trust under subsection A of Section 175.6 of Title 60\n\nof the Oklahoma Statutes, the trustee may furnish to the person a\n\ncertification of trust containing the following information:\n\n1. That the trust exists and the date the trust instrument was\n\nexecuted;\n\n2. The identity of the settlor;\n\n3. The identity and address of the currently acting trustee;\n\n4. The powers of the trustee;\n\n5. The revocability or irrevocability of the trust and the\n\nidentity of any person holding a power to revoke the trust;\n\n6. The authority of co-trustees to sign or otherwise\n\nauthenticate and whether all or less than all are required in order\n\nto exercise powers of the trustee;\n\n7. The trust's taxpayer identification number; and\n\n8. The manner of taking title to trust property.\n\nB. A certification of trust under this section may be signed or\n\notherwise authenticated by any trustee.\n\nC. A certification of trust under this section must state that\n\nthe trust has not been revoked, modified, or amended in any manner\n\nthat would cause the representations contained in the certification\n\nof trust to be incorrect.\n\nD. A certification of trust under this section need not contain\n\nthe dispositive terms of a trust.\n\nE. A recipient of a certification of trust under this section\n\nmay require the trustee to furnish copies of those excerpts from the\n\noriginal trust instrument and later amendments which designate the\n\ntrustee and confer upon the trustee the power to act in the pending\n\ntransaction.\n\nF. A person who acts in reliance upon a certification of trust\n\nunder this section without knowledge that the representations\n\ncontained therein are incorrect is not liable to any person for so\n\nacting and may assume without inquiry the existence of the facts\n\ncontained in the certification. Knowledge of the terms of the trust\n\nmay not be inferred solely from the fact that a copy of all or part\n\nof the trust instrument is held by the person relying upon the\n\ncertification.\n\nG. A person who in good faith enters into a transaction in\n\nreliance upon a certification of trust under this section may\n\nenforce the transaction against the trust property as if the\n\nrepresentations contained in the certification were correct.\n\nH. A person making a demand for the trust instrument in\n\naddition to a certification of trust under this section, or excerpts\n\nof the trust instrument, is liable for damages if the court\n\ndetermines that the person did not act in good faith in demanding\n\nthe trust instrument.\n\nI.
