Stat. tit. 60, § 60-175.19","heading":"Torts of trustee - Exoneration or reimbursement","body":"A trustee who has incurred personal liability for a tort\n\ncommitted in the administration of the trust is entitled to\n\nexoneration therefor from the trust property;\n\nA. If he has not discharged the claim, or to be reimbursed\n\ntherefor out of trust funds if he has paid the claim; if\n\n1. The tort was a common incident of the kind of business\n\nactivity in which the trustee was properly engaged for the trust; or\n\n2. Although the tort was not a common incident of such activity, if\n\nneither the trustee nor any officer or employee of the trustee was\n\nguilty of actionable negligence in incurring the liability.\n\nB. If a trustee commits a tort which increases the value of the\n\ntrust property, he shall be entitled to exoneration or reimbursement\n\nwith respect thereto to the extent of such increase in value, even\n\nthough he would not otherwise be entitled to exoneration or\n\nreimbursement.\n\nWhere the trust instrument reserves to the trustor or vests in\n\nan advisory or investment committee or any other person, including a\n\ncotrustee, authority to direct the making or retention of\n\ninvestments, the excluded trustee or trustees shall not be liable as\n\na trustee for any loss resulting from the making or retention of any\n\ninvestment pursuant to such mandatory direction, except to the\n\nextent the excluded trustee is negligent in carrying out the\n\nexecution of the directed investment or other directed action, and\n\nnothing herein shall relieve any trustee having custody of any asset\n\nfrom liability for exercising due diligence in the safekeeping\n\nthereof.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"580c7388341f107840b1157acf2a597c7f465a959216de52144e877c13cf1480","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-175.18","next":"us-ok/okla.-stat.-tit.-60-60-175.2"},"notice":"GroundRules: Original legal text.
