Stat. tit. 60, § 60-175.202","heading":"Distribution to residuary and remainder beneficiaries","body":"DISTRIBUTION TO RESIDUARY AND REMAINDER BENEFICIARIES\n\nA. Each beneficiary described in paragraph 4 of Section 175.201\n\nof Title 60 of the Oklahoma Statutes is entitled to receive a\n\nportion of the net income equal to the beneficiary's fractional\n\ninterest in undistributed principal assets, using values as of the\n\ndistribution date. If a fiduciary makes more than one distribution\n\nof assets to beneficiaries to whom this section applies, each\n\nbeneficiary, including one who does not receive part of the\n\ndistribution, is entitled, as of each distribution date, to the net\n\nincome the fiduciary has received after the date of death or\n\nterminating event or earlier distribution date but has not\n\ndistributed as of the current distribution date.\n\nB. In determining a beneficiary's share of net income, the\n\nfollowing rules apply:\n\n1. The beneficiary is entitled to receive a portion of the net\n\nincome equal to the beneficiary's fractional interest in the\n\nundistributed principal assets immediately before the distribution\n\ndate, including assets that later may be sold to meet principal\n\nobligations;\n\n2. The beneficiary's fractional interest in the undistributed\n\nprincipal assets must be calculated without regard to property\n\nspecifically given to a beneficiary and property required to pay\n\npecuniary amounts not in trust;\n\n3. The beneficiary's fractional interest in the undistributed\n\nprincipal assets must be calculated on the basis of the aggregate\n\nvalue of those assets as of the distribution date without reducing\n\nthe value by any unpaid principal obligation; and\n\n4. The distribution date for purposes of this section may be\n\nthe date as of which the fiduciary calculates the value of the\n\nassets if that date is reasonably near the date on which assets are\n\nactually distributed.\n\nC. If a fiduciary does not distribute all of the collected but\n\nundistributed net income to each person as of a distribution date,\n\nthe fiduciary shall maintain appropriate records showing the\n\ninterest of each beneficiary in that net income.\n\nD. A fiduciary may apply the rules in this section, to the\n\nextent that the fiduciary considers it appropriate, to net gain or\n\nloss realized after the date of death or terminating event or\n\nearlier distribution date from the disposition of a principal asset\n\nif this section applies to the income from the asset.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"090d2289c5000eab3cc9b78321f40ca6cd237d2fe6893fa6fd66075b9807cae9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-175.201","next":"us-ok/okla.-stat.-tit.-60-60-175.21"},"notice":"GroundRules: Original legal text.
