Stat. tit. 60, § 60-175.47","heading":"Suspension of absolute power of alienation - Period of","body":"suspension.\n\nA. Except as otherwise provided in subsection B of this\n\nsection, the absolute power of alienation of real and personal\n\nproperty, or either of them, shall not be suspended by any\n\nlimitations or conditions for a longer period than during the\n\ncontinuance of a life or lives of the beneficiaries in being at the\n\ncreation of the estate and twenty-one (21) years thereafter. The\n\nabsolute power of alienation is not suspended if there is any person\n\nin being who, alone or in combination with one or more others, has\n\nthe power to sell, exchange, or otherwise convey the real or\n\npersonal property. If the terms of a trust do not suspend the\n\nabsolute power of alienation of any trust property beyond the term\n\npermitted in this subsection, the trust may exist in perpetuity.\n\nB. The provisions of this section shall not apply when property\n\nis given, granted, bequeathed, or devised to:\n\n1. A charitable use;\n\n2. Literary, educational, scientific, religious, or charitable\n\ncorporations for their sole use and benefit;\n\n3. Any cemetery corporation, society or association;\n\n4. The Department of Mental Health and Substance Abuse Services\n\nas provided in Section 2-111 of Title 43A of the Oklahoma Statutes;\n\nor\n\n5. Gifts absolute, limited, or in trust, for the advancement of\n\nmedical science to an incorporated state society of physicians and\n\nsurgeons.\n\nC. Except as provided in this section, the common law rule\n\nagainst perpetuities shall not apply to a trust subject to the trust\n\nlaws of this state.
