Stat. tit. 60, § 60-175.69","heading":"Delegation of investment and management functions","body":"Delegation of Investment and Management Functions.\n\nA. A trustee may delegate investment and management functions\n\nthat a prudent trustee of comparable skills could properly delegate\n\nunder the circumstances. The trustee shall exercise reasonable\n\ncare, skill, and caution in:\n\n1. Selecting an agent;\n\n2. Establishing the scope and terms of the delegation,\n\nconsistent with the purposes and terms of the trust; and\n\n3. Periodically reviewing the agent's actions in order to\n\nmonitor the agent's performance and compliance with the terms of the\n\ndelegation.\n\nB. In performing a delegated function, an agent owes a duty to\n\nthe trust to exercise reasonable care to comply with the terms of\n\nthe delegation.\n\nC. A trustee who complies with the requirements of subsection A\n\nof this section is not liable to the beneficiaries or to the trust\n\nfor the decisions or actions of the agent to whom the function was\n\ndelegated.\n\nD.
