Stat. tit. 60, § 60-175.6a","heading":"Acquiring and holding real property in name of express","body":"trust - Transfer - Memorandum - Presumption for conveyance by\n\ntrustee.\n\nAny estate in real property may be acquired and held in the name\n\nof an express private trust which is a legal entity. Where real\n\nproperty is so acquired, any conveyance, assignment or other\n\ntransfer shall be made in the name of such trust by the trustee or\n\ntrustees of said trust. When real property is transferred or\n\nacquired in the name of the trust after the effective date of this\n\nact, the trustee shall file a memorandum of trust with the county\n\nclerk in which the real property is located. The memorandum of\n\ntrust shall include the date of creation and the name of the trustee\n\nor trustees of the trust.\n\nAny person or persons making such conveyances and executing\n\ninstruments while purporting to be the trustee or trustees of such\n\ntrusts shall be presumed to be acting in the capacity indicated and\n\nwithin the scope of their authority in any action to set aside such\n\nconveyance brought against a bona fide purchaser for value.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"69b2e86a1f43f09bcc87fa66747cd4664406f22f12393903db19c306706f6ede","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-175.69","next":"us-ok/okla.-stat.-tit.-60-60-175.6b"},"notice":"GroundRules: Original legal text.
