Stat. tit. 60, § 60-175.703","heading":"Distribution to second trust - Trustee with full","body":"discretion.\n\nDISTRIBUTION TO SECOND TRUST: TRUSTEE WITH FULL DISCRETION\n\nA. An authorized trustee who has the full discretion to\n\ndistribute the principal or income of a trust may distribute all or\n\npart of the principal of that trust in favor of a trustee of a\n\nsecond trust for the benefit of one, more than one or all of the\n\ncurrent beneficiaries of the first trust and for the benefit of one,\n\nmore than one or all of the successor or presumptive remainder\n\nbeneficiaries of the first trust.\n\nB. The authorized trustee may, in connection with the exercise\n\nof a power of distribution under this section, grant a power of\n\nappointment including a currently exercisable power of appointment,\n\nin the second trust to one or more of the current beneficiaries of\n\nthe first trust who, at the time the power of appointment is\n\ngranted, is eligible to receive a distribution of principal under\n\nthe terms of the first trust.\n\nC. If the authorized trustee grants a power of appointment to a\n\nbeneficiary under subsection B of this section, the class of\n\npermissible appointees in whose favor the beneficiary may appoint\n\nunder that power may be broader or different than the current,\n\nsuccessor, and presumptive remainder beneficiaries of the first\n\ntrust.\n\nD. If the beneficiaries of the first trust are described as a\n\nclass of persons, the beneficiaries of the second trust may include\n\none or more persons who become members of that class after the\n\ndistribution to the second trust.\n\nE.
