Stat. tit. 60, § 60-175.710","heading":"Court-ordered distribution","body":"COURT-ORDERED DISTRIBUTION\n\nA. An authorized trustee may petition a court to order a\n\ndistribution under this act.\n\nB. If the authorized trustee receives a written objection to a\n\ndistribution under this act from a beneficiary before the proposed\n\neffective date of the distribution specified in the notice provided\n\nto the beneficiary under Section 6 of this act, the trustee or the\n\nbeneficiary may petition a court to approve, modify or deny the\n\nexercise of the trustee's power to make a distribution under this\n\nact.\n\nC. If the authorized trustee receives a written objection to\n\nthe distribution from the attorney general not later than the\n\nthirtieth day after the date the notice required by Section 6 of\n\nthis act was received by the attorney general, the trustee shall not\n\nmake a distribution under Section 3 or 4 of this act without\n\npetitioning a court to approve or modify the exercise of the\n\ntrustee's power to make a distribution under this act.\n\nD. In a judicial proceeding under this section, the authorized\n\ntrustee may present the trustee's reasons for supporting or opposing\n\na proposed distribution, including whether the trustee believes the\n\ndistribution would enable the trustee to better carry out the\n\npurposes of the trust.\n\nE. The authorized trustee has the burden of proving that the\n\nproposed distribution furthers the purposes of the trust, is not\n\nexpressly prohibited by the terms of the trust, and is in the\n\ninterests generally of the beneficiaries.\n\nF.
