Stat. tit. 60, § 60-175.83","heading":"Applicable provisions for trusts created or modified","body":"after November 1, 2010.\n\nThe following provisions apply to all trusts created or modified\n\nfrom and after November 1, 2010, regardless of whether a spendthrift\n\nprovision is included in a trust:\n\n1. A distribution interest shall not be judicially sold. A\n\ndistribution interest in a trust includes, but is not limited to, a\n\ncurrent distribution interest, future distribution interest or\n\nincome interest;\n\n2. A remainder interest, power of appointment or a reserved\n\npower in a trust shall not be judicially sold;\n\n3. Except as to a settlor who is also a trustee of a revocable\n\ntrust, trust property is not subject to personal obligations of the\n\ntrustee, even if the trustee becomes insolvent or bankrupt;\n\n4. A beneficiary of a trust has an equitable interest in the\n\ntrust to bring an action against the trustee to enforce the terms of\n\nthe trust subject to the judicial review standard set forth in\n\nparagraph 4 of Section 9 of this act; and\n\n5.
