Stat. tit. 60, § 60-177","heading":"Reformation of offending instruments","body":"Such trusts may be created by written instruments or by will. In\n\nthe case of written instruments, the same shall be subscribed by the\n\ngrantor or grantors and duly acknowledged as conveyances of real\n\nestate are acknowledged, and before the same shall become effective\n\nthe beneficial interest therein shall be accepted by the Governor,\n\nif the state is the beneficiary, or by the governing body of any\n\nother beneficiary named therein, which power and authority of\n\nacceptance hereby is conferred upon the Governor and upon the\n\ngoverning bodies of the counties or municipalities. Provided, every\n\ntrust made hereunder, if the state is the beneficiary, shall, prior\n\nto and as a condition precedent to its entry into force, be\n\nsubmitted to the Attorney General who shall determine whether the\n\ntrust is in proper form and compatible with the laws of this state.\n\nThe Attorney General shall approve any trusts submitted to him which\n\nhe determines to be in proper form and compatible with the laws of\n\nthis state. If approved, the said instrument or will, together with\n\nthe written acceptance of the beneficial interest and approval of\n\nthe Attorney General endorsed thereon, shall be recorded in the\n\noffice of the county clerk of each county wherein is situated any\n\nreal estate, or any interest therein, belonging to said trust, as\n\nwell as in the county wherein is located the trust property or\n\nwherein are conducted its principal operations. In the case of any\n\ntrust of which the State of Oklahoma is the beneficiary, a certified\n\ncopy of such instrument or will and the instrument of acceptance\n\nshall be filed with the Secretary of State. Upon the acceptance of\n\nthe beneficial interest by the beneficiary and approval by the\n\nAttorney General as hereinabove provided, the same shall be and\n\nconstitute a binding contract between the State of Oklahoma and the\n\ngrantor or grantors, or the executor of the estate of the testator,\n\nfor the acceptance of the beneficial interest in the trust property\n\nby the designated beneficiary and the application of the proceeds of\n\nthe trust property and its operation for the purposes, and in\n\naccordance with the stipulations of the trust instrument or will.\n\nSuch trusts shall have duration for the term of duration of the\n\nbeneficiary, or such shorter length of time as shall be specified in\n\nthe instrument or will creating said trust.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"6ad66aef54c65977f3791abf9866330ce0d3b860be8b3bb1a27feec39fc792d8","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-176.1","next":"us-ok/okla.-stat.-tit.-60-60-177.1"},"notice":"GroundRules: Original legal text.
