No public trust as authorized by Section 176 of Title 60 of\n\nthe Oklahoma Statutes shall be a party to any agreement for land,\n\nfinancing or operation of a pari-mutuel horse racing facility in the\n\nState of Oklahoma unless such agreement includes the following terms\n\nand conditions:\n\n1. Said agreement shall indemnify and hold harmless the public\n\ntrust from any financial obligation related to land, financing or\n\noperation by organizational license;\n\n2. Said agreement shall include provisions for the payment of\n\nad valorem property taxes on any improvements and structures on\n\ntrust land which would otherwise be subject to ad valorem property\n\ntaxation if constructed on privately owned land;\n\n3. Such agreement shall prohibit the use of public trust\n\nfinancing for construction of any facilities on all land in the\n\nagreement; and\n\n4. Said agreement shall require that title to any improvements\n\nmust revert to said public trust at the termination of such lease or\n\nagreement.\n\nB.
