Unless there is a written loan agreement to the contrary, a\n\nmuseum may apply conservation measures to or dispose of property on\n\nloan to the museum without a lender's permission if immediate action\n\nis required to protect the property on loan or to protect other\n\nproperty in the custody of the museum, or the property on loan has\n\nbecome a hazard to the health and safety of the public or of the\n\nmuseum's staff, and:\n\n1. The museum cannot reach the lender at the lender's last\n\naddress of record so that the museum and the lender can promptly\n\nagree on a solution; or\n\n2. The lender will not agree to the protective measures the\n\nmuseum recommends, yet is unwilling or unable to terminate the loan\n\nand retrieve the property.\n\nB. If a museum applies conservation measures to or disposes of\n\nproperty under subsection A of this section, the museum:\n\n1. Has a lien on the property and on the proceeds from any\n\ndisposition of the property for the costs incurred by the museum;\n\nand\n\n2. Is not liable for injury to or loss of the property if the\n\nmuseum:\n\na. had a reasonable belief at the time the action was\n\ntaken that the action was necessary to protect the\n\nproperty on loan or other property in the custody of\n\nthe museum, or that the property on loan constituted a\n\nhazard to the health and safety of the public or the\n\nmuseum's staff, and\n\nb. exercised reasonable care in the choice and\n\napplication of the conservation measures.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7ad53517e6dcce294d460f2a96491925166471cab065dadb0dd28bf414dc7163","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-2006","next":"us-ok/okla.-stat.-tit.-60-60-2008"},"notice":"GroundRules: Original legal text.
