Stat. tit. 60, § 60-301.4","heading":"Fiduciary capacities","body":"Charitable organizations shall be permitted to act in the\n\nfollowing fiduciary capacities within this state:\n\n1. To act as trustee under charitable trusts created by will,\n\ninter vivos declaration of trust or trust agreement, corporate\n\nresolution, or order, judgment or decree of any of the courts of\n\nrecord of this state or of any state or of the United States;\n\n2. To accept and execute all charitable trusts and perform such\n\nduties of every description as may be committed to them under such\n\ntrust by any person or persons, any corporation, or any order,\n\njudgment or decree of any of the courts of record of this state or\n\nof any state or of the United States provided that such duties are\n\nnot inconsistent with the charitable, religious, educational, or\n\nother eleemosynary purposes of the charitable organization;\n\n3. To take, accept and hold by gift, grant, assignment,\n\ntransfer, devise or bequest of any person or persons, any\n\ncorporation, or any order, judgment or decree of any of the courts\n\nof record of this state or of any state or of the United States any\n\nreal or personal property as a charitable trust;\n\n4. To execute and perform any and all charitable trusts upon\n\nthe terms, conditions, limitations and restrictions which may be\n\ndeclared, imposed, established or agreed upon in and by the person\n\nor persons, corporation, or order, judgment, decree, gift, grant,\n\nassignment, transfer, devise or bequest establishing such trust;\n\n5. To act as attorney-in-fact for any person establishing a\n\ncharitable trust; and\n\n6. To act as personal representative in the probate of the will\n\nof any decedent, whether such decedent was a resident of this state\n\nor not, and whether the probate of the will of such decedent is by\n\noriginal or ancillary proceeding, where the will makes a present or\n\nfuture gift to or confers a present or future benefit on the\n\ncharitable organization serving as personal representative or one or\n\nmore of its affiliated charitable organizations and the total of all\n\ngifts made to the charitable organization serving as personal\n\nrepresentative or one or more of its affiliated charitable\n\norganizations in the will is as large as the largest distribution\n\nmade to another person who is not a charitable organization, but in\n\nno event shall the total of all gifts made to the charitable\n\norganization serving as personal representative or one or more of\n\nits affiliated charitable organizations in the will be less than\n\ntwenty-five percent (25%) of the estate which is available for\n\ndistribution.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ab73ee60ca67d4fd30cb12a84ab21048a42ab30c8a5be59b71f8fff2c07ad6ad","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-301.3","next":"us-ok/okla.-stat.-tit.-60-60-301.5"},"notice":"GroundRules: Original legal text.
