Stat. tit. 60, § 60-361","heading":"Absentees, who are - Authority to appoint conservator -","body":"Notice of hearing - Production of official statement.\n\nA person hereinafter referred to as an \"absentee\" is one missing\n\nfrom his usual place of residence and his address is unknown by his\n\nfamily or those who, in the ordinary course of events, would be\n\nexpected to know his whereabouts and has been continuously absent\n\nand unheard of for a period of six (6) months or longer, and is\n\npresumed missing and incapable or unable to manage his affairs or\n\nproperty or by permission, assignment or direction of any department\n\nor official of the United States in connection with any activity\n\npertaining to or connected with the prosecution of any war in which\n\nthe United States is then engaged, who has been reported or listed\n\nfor a period not less than three (3) months by the Department of\n\nDefense or other department of the United States as missing, or\n\nmissing in action, or interned in a neutral country, or beleaguered,\n\nbesieged, or captured by an enemy. The judge of the district court\n\nof the county of such absentee's last-known legal domicile upon\n\npetition alleging the foregoing facts and showing the necessity for\n\nproviding care of the property of such absentee made, verified and\n\nfiled by any person who would be entitled to administer upon the\n\nabsentee's estate if he were dead, after causing notice to be given\n\nas hereinafter provided, may, upon good cause being shown, after\n\nfinding the facts to be as aforesaid, appoint a conservator to take\n\ncharge of the absentee's estate under the supervision and subject to\n\nthe further orders of the court, provided, however, that before any\n\nsuch conservator may be appointed notice of the hearing upon the\n\npetition shall be given as is provided by law for hearings upon\n\npetition for appointment of administrators, and in addition thereto,\n\nnotice thereof shall be given to said absentee by publication for\n\ntwo (2) consecutive weeks in a legal newspaper in the county where\n\nsaid proceedings are pending, the last publication of said notice to\n\nbe at least fifteen (15) days before the hearing on said petition.\n\nProvided, further, when the status of absentee is given by the\n\nDepartment of Defense or other department of the United States a\n\nconservator may be appointed only if there is produced at the\n\nhearing an official statement signed by a proper official of the\n\nUnited States Government that there has been no change in the status\n\nof the absentee from the date of the first report, which statement\n\nshall be dated not more than fifteen (15) days before said hearing\n\nor any date to which the same may be continued by order of the\n\ncourt.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"8c1ec185929ffa2a9c63224b7316135b0f49349892cc9393e21acab48a685835","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-36.1","next":"us-ok/okla.-stat.-tit.-60-60-362"},"notice":"GroundRules: Original legal text.
