Stat. tit. 60, § 60-49.12","heading":"Definitions","body":"DEFINITIONS.\n\nIn the Uniform Environmental Covenants Act:\n\n1. “Activity and use limitations” means restrictions or\n\nobligations created under this act with respect to real property;\n\n2. “Agency” means the Department of Environmental Quality or\n\nany other state or federal agency that determines or approves the\n\nenvironmental response project pursuant to which the environmental\n\ncovenant is created;\n\n3. “Common interest community” means a condominium,\n\ncooperative, or other real property with respect to which a person,\n\nby virtue of the person’s ownership of a parcel of real property, is\n\nobligated to pay property taxes or insurance premiums, or for\n\nmaintenance, or improvement of other real property described in a\n\nrecorded covenant that creates the common interest community;\n\n4. “Environmental covenant” means a servitude arising under an\n\nenvironmental response project that imposes activity and use\n\nlimitations;\n\n5. “Environmental response project” means a plan or work\n\nperformed for environmental remediation of real property and\n\nconducted:\n\na. under a federal or state program governing\n\nenvironmental remediation of real property, including\n\nremedial actions provided for in the Oklahoma\n\nEnvironmental Quality Code,\n\nb. incident to closure of a solid or hazardous waste\n\nmanagement unit, if the closure is conducted with\n\napproval of an agency, or\n\nc. under a state voluntary cleanup program authorized in\n\nthe Oklahoma Brownfields Voluntary Redevelopment Act;\n\n6. “Holder” means the grantee of an environmental covenant as\n\nspecified in subsection A of Section 3 of this act;\n\n7. “Person” means an individual, corporation, business trust,\n\nestate, trust, partnership, limited liability company, association,\n\njoint venture, public corporation, government, governmental\n\nsubdivision, agency, or instrumentality, or any other legal or\n\ncommercial entity;\n\n8. “Record”, used as a noun, means information that is\n\ninscribed on a tangible medium or that is stored in an electronic or\n\nother medium and is retrievable in perceivable form; and\n\n9. “State” means a state of the United States, the District of\n\nColumbia, Puerto Rico, the United States Virgin Islands, or any\n\nterritory or insular possession subject to the jurisdiction of the\n\nUnited States.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"4b020ddc6f5f0dafbc1bbd267c57e1be6ce7084984c1bbd381ca522c327b8840","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-49.11","next":"us-ok/okla.-stat.-tit.-60-60-49.13"},"notice":"GroundRules: Original legal text.
