Stat. tit. 60, § 60-49.14","heading":"Contents of environmental covenant","body":"CONTENTS OF ENVIRONMENTAL COVENANT.\n\nA. An environmental covenant must:\n\n1. State that the instrument is an environmental covenant\n\nexecuted pursuant to the Uniform Environmental Covenants Act;\n\n2. Contain a legally sufficient description of the real\n\nproperty subject to the covenant;\n\n3. Describe the activity and use limitations on the real\n\nproperty;\n\n4. Identify every holder;\n\n5. Be signed by the agency, every holder, and every owner of\n\nthe fee simple of the real property subject to the covenant; and\n\n6. Identify the name and location of any administrative record\n\nfor the environmental response project reflected in the\n\nenvironmental covenant.\n\nB. In addition to the information required by subsection A of\n\nthis section, an environmental covenant may contain other\n\ninformation, restrictions, and requirements agreed to by the persons\n\nwho signed it, including any:\n\n1. Requirements for notice following transfer of a specified\n\ninterest in, or concerning proposed changes in use of, applications\n\nfor building permits for, or proposals for any site work affecting\n\nthe contamination on, the property subject to the covenant;\n\n2. Requirements for periodic reporting describing compliance\n\nwith the covenant;\n\n3. Rights of access to the property granted in connection with\n\nimplementation or enforcement of the covenant;\n\n4. Brief narrative description of the contamination and remedy,\n\nincluding the contaminants of concern, the pathways of exposure,\n\nlimits on exposure, and the location and extent of the\n\ncontamination;\n\n5. Limitation on amendment or termination of the covenant in\n\naddition to those contained in Sections 9 and 10 of this act; and\n\n6. Rights of the holder in addition to its right to enforce the\n\ncovenant pursuant to Section 11 of this act.\n\nC.
