Stat. tit. 60, § 60-49.15","heading":"Validity - Effective on other instruments","body":"VALIDITY; EFFECT ON OTHER INSTRUMENTS.\n\nA. An environmental covenant that complies with the Uniform\n\nEnvironmental Covenants Act runs with the land.\n\nB. An environmental covenant that is otherwise effective is\n\nvalid and enforceable even if:\n\n1. It is not appurtenant to an interest in real property;\n\n2. It can be or has been assigned to a person other than the\n\noriginal holder;\n\n3. It is not of a character that has been recognized\n\ntraditionally at common law;\n\n4. It imposes a negative burden;\n\n5. It imposes an affirmative obligation on a person having an\n\ninterest in real property or on the holder;\n\n6. The benefit or burden does not touch or concern real\n\nproperty;\n\n7. There is no privity of estate or contract;\n\n8. The holder dies, ceases to exist, resigns, or is replaced;\n\nor\n\n9. The owner of an interest subject to the environmental\n\ncovenant and the holder are the same person.\n\nC. An instrument that creates restrictions or obligations with\n\nrespect to real property that would qualify as activity and use\n\nlimitations except for the fact that the instrument was recorded\n\nbefore January 1, 2007, is not invalid or unenforceable because of\n\nany of the limitations on enforcement of interests described in\n\nsubsection B of this section or because it was identified as an\n\neasement, servitude, deed restriction, or other interest. The\n\nUniform Environmental Covenants Act does not apply in any other\n\nrespect to such an instrument.\n\nD.
