Stat. tit. 60, § 60-49.19","heading":"Duration - Amendment by court action","body":"DURATION; AMENDMENT BY COURT ACTION.\n\nA. An environmental covenant is perpetual unless it is:\n\n1. By its terms limited to a specific duration or terminated by\n\nthe occurrence of a specific event;\n\n2. Terminated by consent pursuant to Section 10 of this act;\n\n3. Terminated pursuant to subsection B of this section;\n\n4. Terminated by foreclosure of an interest that has priority\n\nover the environmental covenant; or\n\n5. Terminated or modified in an eminent domain proceeding, but\n\nonly if:\n\na. the agency that signed the covenant is a party to the\n\nproceeding,\n\nb. all persons identified in subsections A and B of\n\nSection 10 of this act are given notice of the\n\npendency of the proceeding, and\n\nc. the court determines, after hearing, that the\n\ntermination or modification will not adversely affect\n\nhuman health or the environment.\n\nB. If the agency that signed an environmental covenant has\n\ndetermined that the intended benefits of the covenant can no longer\n\nbe realized, a court, under the doctrine of changed circumstances,\n\nin an action in which all persons identified in subsections A and B\n\nof Section 10 of this act have been given notice, may terminate the\n\ncovenant or reduce its burden on the real property subject to the\n\ncovenant. The agency’s determination or its failure to make a\n\ndetermination upon request is subject to review pursuant to the\n\nAdministrative Procedures Act.\n\nC. Except as otherwise provided in subsections A and B of this\n\nsection, an environmental covenant may not be extinguished, limited,\n\nor impaired through issuance of a tax deed, foreclosure of a tax\n\nlien, or application of the doctrine of adverse possession,\n\nprescription, abandonment, waiver, lack of enforcement, or\n\nacquiescence, or a similar doctrine.\n\nD.
