Stat. tit. 60, § 60-49.20","heading":"Amendment or termination by consent","body":"AMENDMENT OR TERMINATION BY CONSENT.\n\nA. An environmental covenant may be amended or terminated by\n\nconsent only if the amendment or termination is signed by:\n\n1. The agency;\n\n2. The current owner of the fee simple of the real property\n\nsubject to the covenant;\n\n3. Each person that originally signed the covenant, unless the\n\nperson waived in a signed record the right to consent or a court\n\nfinds that the person no longer exists or cannot be located or\n\nidentified with the exercise of reasonable diligence; and\n\n4. Except as otherwise provided in paragraph 2 of subsection D\n\nof this section, the holder.\n\nB. If an interest in real property is subject to an\n\nenvironmental covenant, the interest is not affected by an amendment\n\nof the covenant unless the current owner of the interest consents to\n\nthe amendment or has waived in a signed record the right to consent\n\nto amendments.\n\nC. Except for an assignment undertaken pursuant to a\n\ngovernmental reorganization, assignment of an environmental covenant\n\nto a new holder is an amendment.\n\nD. Except as otherwise provided in an environmental covenant:\n\n1. A holder may not assign its interest without consent of the\n\nother parties; and\n\n2. A holder may be removed and replaced by agreement of the\n\nother parties specified in subsection A of this section.\n\nE.
