Stat. tit. 60, § 60-511","heading":"Liens against unit estates - Discharge","body":"(a) While the property remains subject to this act, no lien\n\nshall arise or be effective against the property as a whole, but\n\nonly against each unit ownership estate and such lien shall attach\n\nin the same manner and under the same conditions in every respect as\n\nliens or encumbrances may arise or be created upon or against any\n\nother separate parcel of real property subject to individual\n\nownership; provided, however, that no labor performed or materials\n\nfurnished with the consent or at the request of a unit owner or his\n\nagent, his contractor, or subcontractor, shall constitute the basis\n\nfor a mechanic's or materialmen's lien against the unit ownership\n\nestate or any other property of any other unit owner who has not\n\nexpressly consented to or requested the same, except that for the\n\npurposes of this act such express consent shall be presumed to have\n\nbeen given by the unit owner in case of emergency repairs thereto.\n\nLabor performed or materials furnished for the common elements, if\n\nduly authorized by the council of unit owners or its duly authorized\n\nagent in accordance with this act, the declaration or bylaws shall\n\nbe deemed to be performed or furnished with the express consent of\n\neach unit owner and shall constitute the basis for a mechanic's or\n\nmaterialmen's lien as now provided by law against each of the unit\n\nownership estates in the property but shall be subject to the\n\nprovisions of subparagraph (b) hereunder.\n\n(b) When a lien against two or more unit owners is asserted,\n\neach unit owner may discharge his unit ownership estate from such\n\nlien by payment to the lienor of the fractional or proportional\n\namount which is attributable to his unit ownership estate. Such\n\nindividual obligation shall be computed by reference to the\n\npercentage of interest set forth in the declaration.
