Stat. tit. 60, § 60-514","heading":"Declaration creating estate - Contents","body":"The declaration creating and establishing unit ownership estates\n\nas provided in Section ;-2 502 of this ;-act title, shall be\n\nrecorded and shall contain the following particulars:\n\n(a) Description of the land,\n\n(b) Description of the building, stating the number of stories\n\nand basements, the number of units, and the principal materials of\n\nwhich it is constructed,\n\n(c) The unit designation of each unit, and a statement of its\n\nlocation, approximate area, number of rooms, and immediate common\n\narea to which it has access, and any other data necessary for its\n\nproper identification,\n\n(d) Description of the general common elements and the\n\nproportionate interest of each unit owner therein,\n\n(e) Description of the limited common elements, if any, stating\n\nwhich units shall share the same and in what proportion,\n\n(f) The name of a person to receive service of process in the\n\ncases hereinafter provided together with the residence or place of\n\nbusiness of such person which shall be within the county in which\n\nthe property is located,\n\n(g) The method which the declaration may be amended, consistent\n\nwith the provisions of this act,\n\n(h) Any other details or restrictions in connection with the\n\nproperty which the person executing the declaration may deem\n\ndesirable to set forth;-.,\n\n(i) The declarant by a specific provision in the declaration may\n\nreserve the right to annex additional property to the property which\n\nwas submitted to the Unit Ownership Estate Act under the original\n\ndeclaration. If such right is reserved, the declaration shall also\n\ninclude:\n\n(1) The legal description of the property capable of being\n\nannexed, and the total number of units that may be added by one or\n\nmore such annexations;\n\n(2) The time limit within which the annexation shall take\n\nplace from the recordation date of the original declaration;\n\n(3) A requirement that all improvements intended for the\n\nproperty of each annexation shall be substantially complete prior to\n\neach such annexation;\n\n(4) The formula for determining the undivided interest of\n\neach unit owner in the total common elements after each such\n\nannexation, which formula may not be changed without the unanimous\n\nconsent of all the unit owners, and which formula shall be\n\nreasonably expected to result in a ratio of the approximate relation\n\nof the value of each unit after each annexation as it bears to the\n\naggregate fair value of all units after each such annexation;\n\n(5) A description of the annexation document to be executed\n\nand recorded by the declarant which shall not require the consent of\n\nthe unit owners. The annexation document shall state the undivided\n\ninterest of each unit owner in the common elements for each unit\n\nwhich is a part of the total property after such annexation.\n\nHowever, such undivided interest may be later changed in accordance\n\nwith the act by a later annexation;\n\n(6) A requirement that the improvements on the property to\n\nbe annexed will be consistent with the improvements of the property\n\noriginally submitted to the declaration in terms of quality and\n\nconstruction; and (j) The specific formula for determining the\n\namount of contribution to be made by the declarant for unconstructed\n\nunits and/or unconstructed buildings if such contribution is less\n\nthan the pro rata contribution of the expenses described in\n\nsubsection (a) of Section 512 of this title.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"79030a872ed95dda6f244de8a712a47dd2929ecd8281ea15feb911dda1973287","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-513","next":"us-ok/okla.-stat.-tit.-60-60-515"},"notice":"GroundRules: Original legal text.
