Any sum payable on a check, certified check, cashier's\n\ncheck, draft, or similar instrument, except those subject to Section\n\n651.1 of this title, on which a banking or financial organization is\n\ndirectly liable, which has been outstanding for more than five (5)\n\nyears after it was payable or after its issuance if payable on\n\ndemand, is presumed abandoned, unless the owner, within five (5)\n\nyears, has communicated in writing with the banking or financial\n\norganization concerning it or otherwise indicated an interest as\n\nevidenced by a memorandum or other record, on file, prepared by an\n\nemployee thereof.\n\nB. A record of the issuance of a check, draft, or similar\n\ninstrument shall be prima facie evidence of an obligation.\n\nC. The burden of proof upon the State Treasurer in claiming\n\nproperty from a holder, who is also the issuer, shall be satisfied\n\nby demonstrating the issuance of the instrument and the passage of\n\nthe requisite period of abandonment as provided in subsection A of\n\nthis section.\n\nD. The holder may assert affirmative defenses of:\n\n1. Payment;\n\n2. Satisfaction;\n\n3. Discharge; and\n\n4.
