Upon the payment or delivery of abandoned property to the\n\nState Treasurer, the state assumes custody and responsibility for\n\nthe safekeeping of the property. A person who pays or delivers\n\nproperty to the State Treasurer in good faith is relieved of all\n\nliability to the extent of the value of the property paid or\n\ndelivered for any claim then existing or which thereafter may arise\n\nor be made in respect to the property.\n\nB. A holder who has paid money to the State Treasurer pursuant\n\nto the Uniform Unclaimed Property Act may make payment to any person\n\nappearing to the holder to be entitled to payment; and upon filing\n\nproof of such payment and proof that the payee was entitled thereto,\n\nthe State Treasurer shall promptly reimburse the holder for the\n\npayment without imposing a fee or other charge. If reimbursement is\n\nsought for a payment made on a negotiable instrument, including a\n\ntravelers check or money order, the holder shall be reimbursed under\n\nthis subsection upon filing proof that the instrument was presented\n\nand that payment was made to a person who appeared to the holder to\n\nbe entitled to payment. The holder shall be reimbursed for payment\n\nmade under this subsection even if the holder paid a person whose\n\nclaim was barred under subsection A of Section 666 of this title.\n\nC. A holder who has delivered property, including, but not\n\nlimited to, a certificate of an ownership interest in a business\n\nassociation, other than money to the State Treasurer pursuant to the\n\nUniform Unclaimed Property Act may reclaim the property if still in\n\nthe possession of the Treasurer, without paying any fee or other\n\ncharge, upon filing proof that the owner has claimed the property\n\nfrom the holder.\n\nD. The State Treasurer may accept the holder's affidavit as\n\nsufficient proof of the facts that entitle the holder to recover\n\nmoney and property under this section.\n\nE. If the holder pays or delivers property to the State\n\nTreasurer in good faith and thereafter another person claims the\n\nproperty from the holder or another state claims the money or\n\nproperty under its laws relating to escheat or abandoned or\n\nunclaimed property, the State Treasurer, upon written notice of the\n\nclaim, shall defend the holder against the claim and, to the extent\n\nof the property's value, shall indemnify the holder against\n\nliability on the claim. Neither the holder nor the State Treasurer\n\nshall be liable for more than the value of the property, determined\n\nas of the time of its payment or delivery to the State Treasurer, if\n\nthe holder paid or delivered the property to the State Treasurer in\n\ngood faith.\n\nF. For the purposes of this section, \"good faith\" means that:\n\n1. Payment or delivery was made in a reasonable attempt to\n\ncomply with the Uniform Unclaimed Property Act;\n\n2. The person delivering the property was not a fiduciary then\n\nin breach of trust in respect to the property and had a reasonable\n\nbasis for believing, based on the facts then known, that the\n\nproperty was abandoned for the purposes of the Uniform Unclaimed\n\nProperty Act;\n\n3. There is no showing that the records under which the\n\ndelivery was made did not meet reasonable commercial standards of\n\npractice in the industry; and\n\n4.
