Stat. tit. 60, § 60-74","heading":"Joint tenancy and tenancy by entirety","body":"A joint interest is one owned by several persons in either real\n\nor personal property in equal shares, being a joint title created by\n\na single instrument, will or transfer when expressly declared in the\n\ninstrument, will or transfer to be a joint tenancy, or as between\n\nhusband and wife a tenancy by entirety or joint tenancy as the\n\ngrantor may elect, or when granting or devising to executors or\n\ntrustees as joint tenants. A tenancy by entirety can only be\n\ncreated between husband and wife.\n\nSuch joint tenancy or tenancy by entirety may be created by\n\ntransfer to persons as joint tenants or tenants by entirety from an\n\nowner or a joint owner to himself and one or more persons, or from\n\ntenants in common to themselves, or by coparceners in voluntary\n\npartition, and such estates may be created by or for persons who\n\nhave elected to become bound under any community property act now in\n\nexistence or which may hereafter be enacted. An adjudication of\n\nincompetency shall not operate to terminate such an estate.\n\nWhere a deed, transfer or conveyance grants an estate in joint\n\ntenancy or tenancy by entirety in the granting clause thereof, the\n\ngranting clause shall control over the habendum clause containing\n\nlanguage inconsistent to the granting clause.\n\nIn the event of the death of a joint tenant or tenant by\n\nentirety, leaving estate subject to probate, a certified copy of\n\nletters testamentary or of administration shall constitute prima\n\nfacie evidence of such death.\n\nThe provisions of this act shall apply to all estates in joint\n\ntenancy or tenancy by entirety in either real or personal property\n\nheretofore or hereafter created.\n\nNothing herein contained shall prevent execution, levy and sale\n\nof the interest of the judgment debtor in such estates and such sale\n\nshall constitute a severance.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7988350397e0c782e9dbe36d271dcfc21ceb51a72e82080d6cf21802b6448d77","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-73","next":"us-ok/okla.-stat.-tit.-60-60-74.1"},"notice":"GroundRules: Original legal text.
