Stat. tit. 60, § 60-755","heading":"Disposition of interest disclaimed","body":"Unless otherwise provided in the nontestamentary instrument\n\ncreating the interest with reference to the possibility of a\n\ndisclaimer by the beneficiary, the interest disclaimed shall be\n\ndistributed or otherwise be disposed of in the same manner as if the\n\ndisclaimant had died immediately preceding the death or other event\n\nwhich causes him to become finally ascertained as a beneficiary and\n\nhis interest to become indefeasibly fixed both in quality and\n\nquantity and, in any case, the disclaimer shall relate for all\n\npurposes to that date, whether filed before or after such death or\n\nother event. However, one disclaiming an interest in a nonresiduary\n\ngift under a trust instrument or otherwise shall not be excluded,\n\nunless his disclaimer so provides, from sharing in a gift of the\n\nresidue even though, through lapse, such residue includes the assets\n\ndisclaimed. If the disclaimer pertains to a joint tenancy interest\n\nin property, the interest disclaimed shall be distributed or\n\notherwise be disposed of in the same manner as if the disclaimant\n\nhad died immediately preceding the death of the other person having\n\na joint tenancy interest in the same property whose death most\n\nclosely preceded the effective date of the disclaimer or, if no\n\nperson having a joint tenancy interest has died, then as if the\n\ndisclaimant never owned the joint tenancy interest which was\n\ndisclaimed.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a4cf48329854e3def67906f7e18ec0e83c5db302e2544381ef9cff547e9274e9","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-754","next":"us-ok/okla.-stat.-tit.-60-60-756"},"notice":"GroundRules: Original legal text.
