Stat. tit. 60, § 60-813","heading":"Governmental authority holding only easements for use as","body":"rights-of-way.\n\nIn situations in which a governmental authority or agency holds\n\nonly an easement for use as a right-of-way over land on which is\n\nconstructed a highway, street, road, alley or bridge:\n\n1. The governmental authority or agency shall possess for and\n\non behalf of the public the right to use such easement for highway,\n\nstreet, road, alley or bridge purposes with full, free and\n\nunobstructed passage over such improvement as well as the right to\n\nconstruct, maintain, repair, alter and remove such improvement,\n\nsubject to all other laws pertaining thereto; and\n\n2. In addition thereto, the governmental authority and agency\n\nshall possess for and on behalf of the public the right to make full\n\nuse of the airspace over, under or upon said right-of-way, provided\n\nthat the residual right, title, interest and estate of the owner or\n\nowners of the fee in and to the land on which said improvement\n\nexists shall not in any way be encumbered, limited or additionally\n\nburdened without just compensation being paid to such owner or\n\nowners and with the determination of such just compensation to be\n\nmade in the manner provided by law for additional takings under the\n\npower of eminent domain.","path":["OK Code","Title 60"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os60.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"729e63a1b8e1fff26ecde14336d1e74bdcb0b2e0a7d6f36e4d218dda160d487e","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-60-60-812","next":"us-ok/okla.-stat.-tit.-60-60-814"},"notice":"GroundRules: Original legal text.
