Stat. tit. 61, § 61-102","heading":"Definitions","body":"As used in the Public Competitive Bidding Act of 1974:\n\n1. \"Awarding public agency\" means the public agency which\n\nsolicits and receives sealed bids on a particular public\n\nconstruction contract;\n\n2. \"Bidding documents\" means the bid notice, instruction to\n\nbidders, plans and specifications, bidding form, bidding\n\ninstructions, general conditions, special conditions and all other\n\nwritten instruments prepared by or on behalf of an awarding public\n\nagency for use by prospective bidders on a public construction\n\ncontract;\n\n3. \"Chief administrative officer\" means an individual\n\nresponsible for directing the administration of a public agency.\n\nThe term does not mean one or all of the individuals that make\n\npolicy for a public agency;\n\n4. \"Construction management trade contract or subcontract\"\n\nmeans any public construction contract exceeding Fifty Thousand\n\nDollars ($50,000.00) in amount that is awarded as a trade contract\n\nin an agency construction management contract or awarded as a\n\nsubcontract in an at-risk construction management contract;\n\n5. \"Public agency\" means the State of Oklahoma, and any county,\n\ncity, town, school district or other political subdivision of the\n\nstate, any public trust, any public entity specifically created by\n\nthe statutes of the State of Oklahoma or as a result of statutory\n\nauthorization therefor, and any department, agency, board, bureau,\n\ncommission, committee or authority of any of the foregoing public\n\nentities;\n\n6. \"Public construction contract\" or \"contract\" means any\n\ncontract, exceeding One Hundred Thousand Dollars ($100,000.00) in\n\namount, or any construction management trade contracts or\n\nsubcontracts exceeding Fifty Thousand Dollars ($50,000.00) in\n\namount, awarded by any public agency for the purpose of making any\n\npublic improvements or constructing any public building or making\n\nrepairs to or performing maintenance on the same except where the\n\nimprovements, construction of any building or repairs to the same\n\nare improvements or buildings leased to a person or other legal\n\nentity exclusively for private and not for public use and no public\n\ntax revenues shall be expended on or for the contract unless the\n\npublic tax revenues used for the project are authorized by a\n\nmajority of the voters of the applicable public agency voting at an\n\nelection held for that purpose and the public tax revenues do not\n\nexceed twenty-five percent (25%) of the total project cost. The\n\namount of public tax dollars committed to the project will not\n\nexceed a fixed amount established by resolution of the governing\n\nbody prior to or concurrent with approval of the project;\n\n7. \"Public improvement\" means any beneficial or valuable change\n\nor addition, betterment, enhancement or amelioration of or upon any\n\nreal property, or interest therein, belonging to a public agency,\n\nintended to enhance its value, beauty or utility or to adapt it to\n\nnew or further purposes. The term does not include the direct\n\npurchase of materials, equipment or supplies by a public agency, or\n\nany personal property, including property as defined in paragraphs 1\n\nand 4 of subsection B of Section 430.1 of Title 62 of the Oklahoma\n\nStatutes;\n\n8. \"Purchasing cooperative\" means an association of public\n\nentities working together to provide leverage in achieving best\n\nvalue and/or the best terms in contracts awarded through a\n\ncompetitive bidding process; and\n\n9. \"Retainage\" means the difference between the amount earned\n\nby the contractor on a public construction contract, with the work\n\nbeing accepted by the public agency, and the amount paid on said\n\ncontract by the public agency.","path":["OK Code","Title 61"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os61.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"d964cf613a87832e3d4aef04edcf0098e1e284bc0a4531185019527f91fbcd70","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-61-61-101","next":"us-ok/okla.-stat.-tit.-61-61-103"},"notice":"GroundRules: Original legal text.
